RESEARCH OBJECTIVE: The aim of the study is to analyze the special role of the family in the development of a child, its humanity and its development needs, taking into account human rights, including the child’s rights, as well as theories and philosophies of law. THE RESEARCH PROBLEM AND METHODS: The research problem is a special role in the process of human development. In terms of the adopted methodology, the assumptions of the personalistic philosophy, the philosophy of dialogue, human rights and the philosophy of responsibility, as well as analysis and criticism of the literature were used. THE PROCESS OF ARGUMENTATION: The study draws attention to the difficulties appearing in the proper upbringing of children that arise in connection with the developing media, the lack of responsibility and maturity to fulfill the parental roles. RESEARCH RESULTS: The research undertaken indicates the need to improve parental knowledge, competences and skills, both in parents and in those who intend to become parents, with respect for the subjectivity and personal dignity of the child. CONCLUSIONS, INNOVATIONS, AND RECOMMENDATIONS: It is proposed to educate parents and future parents in the field of correct parental attitudes, building a personal relationship with the child in order to shape its humanity.

CEL NAUKOWY: Celem opracowania jest analiza szczególnej roli rodziny w rozwoju dziecka, jego człowieczeństwa i potrzeb jego rozwoju, uwzględniając prawa człowieka w tym dziecka oraz teorie i filozofie prawa. PROBLEM I METODY BADAWCZE: Problemem badawczym jest swoista rola rodziny w procesie rozwoju człowieczeństwa. W zakresie przyjętej metodologii zastosowano założenia filozofii personalistycznej, filozofii dialogu, praw człowieka i filozofii odpowiedzialności, a także analizę i krytykę literatury. PROCES WYWODU: Opracowanie zwraca uwagę na trudności pojawiające się w prawidłowym wychowaniu dzieci w związku z rozwijającymi się mediami, brakiem odpowiedzialności i dojrzałości do pełnienia ról rodzicielskich. WYNIKI ANALIZY NAUKOWEJ: Podjęte badania wskazują na konieczność podnoszenia wiedzy i umiejętności rodzicielskich zarówno u rodziców, jak i u osób zamierzających zostać rodzicami z poszanowaniem podmiotowości i godności osobowej dziecka. WNIOSKI, INNOWACJE, REKOMENDACJE: Proponuje się edukowanie rodziców oraz przyszłych rodziców w zakresie prawidłowych postaw rodzicielskich, budowania relacji osobowej z dzieckiem w celu kształtowania w nim człowieczeństwa

Over the last years, the number of both national and foreign adoptions has been decreasing. In the years 2015–2018 the number of adoption decisions went down by over 20 percent. NIK decided to examine whether adoption centres perform their tasks related to adoption procedures in an appropriate and effective manner. During the audit, NIK checked, among others, whether the process of qualifying children for adoption and the adoption procedures, national and foreign alike, were compliant with the legal requirements and what the level of effectiveness of those activities was. Another issue audited concerned whether adoption centres provided for an appropriate and efficient selection of adoption parents. Finally, NIK evaluated the activities of regional governors as for the compliance of the organising and financing of adoption centres, and how the regional boards controlled their activities.

Bearing in mind the constitutional right of parents to raise their children in accordance with their beliefs, but also the constitutional obligation to protect children against demoralization, first the Council of Ministers, then a group of members of the Sejm of the Republic of Poland, and finally citizens numbering over 250,000 decided on legislative initiatives aimed at amending the education law in such a way that extracurricular activities in schools are completely transparent, and thus parents’ decisions about the participation of their children in such activities are fully conscious and responsible. The legislative process of the citizens’ project “Let’s protect children. Let’s support parents” has not yet been completed. On September 7, 2023, the Senate rejected this law in its entirety. Due to the fact that citizen laws are not subject to continued work, the Senate resolution will be considered by the Sejm of the Republic of Poland in the next term, which began on November 13, 2023.

Mając na względzie konstytucyjne prawo rodziców do wychowania dzieci zgodnie ze swoimi przekonaniami, ale także konstytucyjny obowiązek ochrony dzieci przed demoralizacją, najpierw Rada Ministrów, a następnie grupa posłów na Sejm RP, a w końcu obywatele w liczbie ponad 250 tys. zdecydowali się na inicjatywy ustawodawcze zmierzające do nowelizacji prawa oświatowego w taki sposób, aby zajęcia pozalekcyjne w szkołach były całkowicie transparentne, a przez to decyzje rodziców o udziale ich dzieci w takich zajęciach były całkowicie świadome i odpowiedzialne. Proces legislacyjny obywatelskiego projektu „Chrońmy dzieci. Wspierajmy rodziców” nie został jednak nadal zakończony. Senat w dniu 7 września 2023 r. ustawę tę odrzucił w całości. Z uwagi na to, że obywatelskie projekty ustaw nie podlegają dyskontynuacji prac, toteż uchwałą senacką zajmie się Sejm RP kolejnej kadencji, która rozpoczęła się 13 listopada 2023 r.
