Complaint proceedings against a property developer on account of defects in real estate in light of the new Development Act

This article is a description of the acceptance procedure under the new Development Act, which came into force on 1 July 2022. The process described relates to the common situation where a defect has become apparent in a property or a single-family house at the stage preceding the conclusion of the final agreement with the developer. The intention of the authors of this article is to describe the course of the acceptance procedure in the light of the complicated Article 41 of the new developer's Act, i.e. the Act on the Protection of the Rights of the Purchaser of a Dwelling or Single-Family House and the Developer's Guarantee Fund (Journal of Laws 2021, item 1177). This provision redefined the rules creating the rights and obligations of the parties to contracts to which the described Act applies.

Wykorzystując zdarzenie drogowe, w którym doszło do potrącenia osoby pieszej, autor zrelacjonował jego przebieg i proces rekonstrukcji, kładąc szczególny nacisk na kwestie związane z ustaleniem odległości dostrzeżenia przeszkody w warunkach nocnych. Ustalenie tej odległości na drodze oświetlonej latarniami ulicznymi w złych warunkach atmosferycznych wymaga wykonania eksperymentu. Autor zwrócił uwagę na potrzebę dołożenia wszelkich starań, aby uzyskać w czasie eksperymentu warunki drogowe jak najbardziej zbliżone do panujących w czasie wypadku oraz by uczestnicy eksperymentu nie wypatrywali przeszkody w miejscu, w którym znajduje się pozorant.

The author describes an accident in which a pedestrian was hit and the process of its reconstruction with special focus on the issues of establishing the distance of sighting an obstacle at nighttime. To establish this distance on a road illuminated with a lamp post in poor atmospheric conditions it is necessary to perform an experiment. The author emphasizes the need for taking every effort to replicate the road conditions during the experiment closest possible to those during the accident. He also points to the necessity of taking care that the experiment participants do not watch for the obstacle in the place where the helper is located.

W artykule omówione są ważniejsze działania Sejmu zmierzające do wykorzystania energii z zasobów odnawialnych, stan realizacji przez Rząd RP rezolucji Sejmu z dnia 8 listopada 1999 roku oraz poglądy i opinie ekspertów sejmowych i innych na temat kierunków wykorzystania energii z zasobów odnawialnych. Znajdują się również propozycje dotyczące kierunków działań rządu, samorządów lokalnych, podmiotów gospodarczych i jednostek badawczych, zmierzające do pełnego wykorzystania rodzimych zasobów energii, poprawienia stanu środowiska przyrodniczego i poziomu życia mieszkańców.

The most important activities of the Seym aiming at the utilisation of energy from the renewables, the state of realisation of the Seym resolution of 8 November 1999 by the Polish Government as well as opinions of Seym and other experts on the directions of energy use from the renewables have been presented in this paper. There are also suggestions on the directions which the Government, local selfgovernments, economic entities and research centres should follow in their activities to fully utilise the Polish energy resources, to improve the state of the environment and improve the life standard.

Przedstawiono wyniki badań ankietowych przeprowadzonych wśród 39 ekspertów [1] - naukowców i praktyków - w dziedzinie handlu detalicznego i hurtowego. W ocenie ekspertów, funkcjonujące obecnie w Polsce kanały dystrybucji żywności są nienowoczesne. Pod wpływem zagranicznych sieci handlowych, w dziedzinie dystrybucji żywności zaszły już pewne zmiany, chociaż z drugiej strony, obecność i siła ekonomiczna zagranicznych dystrybutorów niesie ze sobą również pewne zagrożenia dla krajowych firm zajmujących się handlem żywnością. W przyszłości, zdaniem specjalistów, należy spodziewać się rosnącej roli właśnie super- i hipermarketów oraz ogólnopolskich sieci hurtowych.

The results of survey, conducted among 39 experts - scientists and practitioners in the field of retail and wholesale trade, have been presented. In the opinion of experts, the present channels of food distribution in Poland are out of dale. Certain changes in food distribution, as affected by foreign trade network have already taken place; on the other hand, the presence and economic power of foreign distributors brings also certain threat to home companies, dealing with food trade. In the future, in the opinion of specialists, we should expect just the growing role of supermarkets and hipermarkets and all-national wholesale network.
