Effects of the COVID-19 pandemic on the notification of protective masks to the RAPEX system

The aim of the study is to assess the notification of protective masks to the RAPEX system. The coercion to wear protective masks at the beginning of the CoViD-19 pandemic led to significant, unexpected demand for these products. The sudden increase in demand caused an initial lack of availability of the masks for consumers but their supply to the market subsequently increased. At the same time, market surveillance authorities detected a significant number of cases of non-compliance as a result of numerous checks. The impact of the CoViD-19 pandemic on the number and types of notifications for protective masks to the EU’s system for the rapid exchange of information on dangerous non-food products (RAPEX) was examined. Based on the results, the conclusion is that the CoViD-19 pandemic had a significant impact on the number of notifications regarding protective masks. The assumption regarding the country of origin of the notified masks was also confirmed, as the highest number of notifications concerning protective masks originating in China were notified to RAPEX in 2020, 2021 and 2022. Germany and Belgium were the countries giving notifications for these products.

Przedstawiono wyniki analizy notyfikacji wyrobów kosmetycznych niezgodnych z wymaganiami prawnymi, zgłoszonych do systemu Rapex. Zidentyfikowano grupy występujących ryzyk oraz substancji chemicznych, które stanowiły najczęstszą podstawę zgłoszenia wyrobów. Substancjami, które najczęściej występowały w zgłaszanych kosmetykach były: hydrochinon, dibutyloftalan, ołów, rtęć i konserwanty m.in. formaldehyd. Najwięcej notyfikacji potencjalnie niebezpiecznych produktów kosmetycznych zostało zgłoszonych w Niemczech, a najwięcej kosmetyków niezgodnych z wymaganiami pochodziło z USA i Chin.

System RAPEX służy do szybkiej wymiany informacji na temat wykrytych na rynku europejskim produktów niebezpiecznych dla konsumenta oraz podjętych wobec nich środków, łącznie z wycofaniem z rynku i zniszczeniem. Informacje te wymieniane są pomiędzy krajami Europejskiego Obszaru Gospodarczego i Komisją Europejską. Jest to jednak działanie typu ex post i nie ma bezpośredniego wpływu na zwiększenie ilości produktów bezpiecznych oferowanych na rynku europejskim. Wręcz przeciwnie, ilość notyfikacji w systemie RAPEX ciągle wzrasta. Szczególną uwagę zwraca duża ilość produktów niebezpiecznych z krajów spoza Europejskiego Obszaru Gospodarczego, przeważnie z Chin. Świadczy to o tym, że producenci chińscy nie przywiązują dużej wagi do bezpieczeństwa produktów, a z drugiej strony na rynku europejskim nie przeprowadza się wystarczającej kontroli tych produktów. Dlatego też organy Unii Europejskiej powinny podjąć znacznie bardziej skuteczne działania w tym zakresie.

The RAPEX system is used to the rapid exchange of information on the detected in the European market dangerous products for consumers and measures taken against them, including the withdrawal from the market and destruction. This information is exchanged between the countries of the European Economic Area and the European Commission. However, this is an ex post action and has no direct influence on the increasing the amount of safe products offered on the European market. On the contrary, the number of notifications in the RAPEX system is still increasing. The particular attention pays a large number of dangerous products from countries outside the European Economic Area, mostly from China. This indicates that the Chinese producers do not attach much importance to the products safety, on the other hand on the European market is not carried out sufficient control of these products. Consequently, the authority of the European Union should take a much more effective actions in this regard.
