The subject of this paper are guarantees of religious freedom – in an individual, community and institutional dimension – included in the concordat between the Holy See and the Republic of Cape Verde on 10 June 2013. Prepared over many years and concluded 37 years after the independence of the Republic of Cape Verde, it was signed by Archbishop Dominique Mamberti, who represented the Holly See, and Jorge Alberto da Silva Borges, the Minister of Foreign Affairs of the Republic of Cape Verde. The regulation of this convention (which consists of a preamble and 30 articles) provides for the legal status of the Catholic Church in reference to more than twenty detailed issues, which is typical of the so-called exhaustive concordats, which include the whole range of issues both parties are interested in. When describing a concordat, it needs to be mentioned that what is striking in them is above all full respect and appreciation of the rule of religious freedom, in all its dimensions and aspects.

The subject of the thesis is the institution of a metropoly (a church district) and the authority governing the metropolitan territorial unit in the historical and legal perspective. After presenting the genesis and beginnings of forming of the metropoly in ancient times, the author describes its further, dynamic development in medieval decretals. Next, the author focuses on a reform carried out by the Trent Council (1545-1563) and analyses its reformation decretals. In the following part of the thesis the author discusses relevant provisions of the Canon Law of 1917. Finally, he reviews the directive of the Council of Vatican II (1962-1965) and provisions of the Canon Law of 1983, in which previous provi-sions have been largely simplii ed. Documents of the Holy See issued while this Canonic Law was in force (Exhortation of John Paul II Pastores gregis of 16 October 2003 and documents of the Directory of Congregation for Bishops Apostolorum successores of 22 February 2004) have also been considered.Having analysed provisions of the Canon Law of 1983 and the above successive documents regarding the metropoly and the oi ce of the metropolitan bishop over the ages, on one hand, a i delity to centuries-old tradition can be observed, but on the other hand, perceiving the institution of the metropoly in a more pastoral perspective meeting requirements of modern times.

Znaczącym novum KPK z 1983 r. jest nadanie waloru dowodowego oświadczeniom stron w sprawach nullitatis matrimonii (can. 1536 § 2), co powtarza instrukcja Dignitas connubii (art. 180 § 1). Ponadto w art. 181 tejże instrukcji stwierdza się, iż gdy chodzi o zeznania stron pozasądowe przeciwko ważności małżeństwa oraz inne ich oświadczenia pozasądowe przedstawione w sądzie, to do sędziego należy ocena ich znaczenia, po wzięciu pod uwagę wszystkich okoliczności. Z kolei motu proprio Franciszka Mitis Iudex stanowi, iż w sprawach o nieważność małżeństwa zeznanie sądowe i oświadczenia stron, wsparte znacząco przez świadków co do ich wiarygodności, mogą mieć moc pełnego dowodu, którą winien ocenić sędzia, uwzględniając wszystkie wskazówki i poszlaki. Analiza orzecznictwa Roty Rzymskiej w sprawach z symulacji pozwala poznać szereg wypracowanych przez ten trybunał zasad interpretacyjnych w odniesieniu zarówno do confessio iudicialis, jak i extraiudicialis. Jednocześnie potwierdza, że walor dowodowy w postaci confessio simulantis w obszarze wymienionej kategorii spraw jest znaczący.

An important novum in the Code of Canon Law dated 1983 is placing a proof value on statements of parties in nulliatits matrimonii cases (can. 1536 § 2), which is repeated in Dignitas connubii Instruction (art. 180 § 1). What is more, it is stated in art. 181 of this Instruction that when it comes to extrajudicial statements of parties concerning the validity of marriage as well as other their extrajudicial statements presented in court, it is a judge whose role is to evaluate their importance, after considering all circumstances. Francis’ Mitis Iudex motu proprio on the other hand states that in cases on the validity of marriage court testimonies and statements of parties, the credibility of which is importantly supported by witnesses, can serve as full evidence, which should be evaluated by a judge who takes all hints and circumstantial evidence into account. The analysis of the Roman Rota judicature in cases on simulation enables to learn about a number of interpretational rules developed by this tribunal both in relation to confession iudicialis and extraiudicalis. At the same time it confirms that the proof value in the form of confession simulantis in the area of the abovementioned category of matter is of importance.

The subject of the annual, latest – as it turned out – speech of Benedict XVI to the Tribunal of the Roman Rota dated 26 January 2013 pertains to the relationship between faith and marriage, in the context of the Year of Faith. It takes into consideration the current crisis of the faith, which is affecting the contemporary human being, bringing with it a crisis of the conjugal society. The Holy Father refers to i.e. John Paul II and explains that the faith of the party who is baptised is not necessary for contracting sacramental marriage. It requires from those engaged to be married the true intention to contract the marriage according to the natural reality of matrimony. At the same time Benedict XVI pays attention to the fact, that lack of faith may cause the simulation of consent, i.e. according to the bonum coniugum.
