The essay focuses on the internal market as a factor determining EU consumer policy. Minimum standard harmonization in the field of consumer legislation is regarded as one of the main reasons of a decomposition of the internal market. Huge and negative impact of minimum standard on legal and socio-economic aspects of internal market functioning is not difficult to identify. Only maximum harmonization may constitute a remedy for the decomposition problem. It understands that internal market is a factor of great importance for B2C relations. On the other hand, maximum level of harmonization can be dangerous for national legal orders of EU member states. This is why maximum level of harmonization should be applied under certain conditions, listed in the essay. Unfortunately, draft of the consumer rights directive, does not meet even basic requirements of good legislation.
