The article analyses issues related to the establishment of a certain legal age as a prerequisite for bearing criminal responsibility, the measures and punishments which may be applied to juveniles, and the procedures under which such measures and punishments are imposed. As a result of the analysis, the authors recommend that sanctions for status offences be abolished, restorative justice for juvenile offences be introduced, and specialization of competent authorities be established, allowing them to take into account the age of the concrete child-offender concerned during the conducting of all their actions and sanctions.

Článek se zabývá otázkami souvisejícími se zákonným stanovením věkové hranice jako předpokladu pro trestněprávní odpovědnost, s opatřeními a tresty, jež lze uplatňovat vůči mladistvým delikventům, a s postupy, podle nichž jsou přijímány příslušná opatření a vyměřovány příslušné tresty.Na základě analýzy autoři doporučují, aby byl zrušen postih tzv. statusových přestupků proti zákonu, aby byla zavedena restorativní justice, a aby byly zřízeny specializované kompetentní úřady, jež by braly v úvahu věkmladistvého provinilce v průběhu celého konání, včetně vyměření příslušných sankcí.
