Der Beitrag enthält eine Analyse von Paralleltexten des Arbeitsvertrags in Deutsch und in Polnisch. Dargestellt werden außerdem die rechtlichen Regelungen in beiden Rechtssystemen in Bezug auf den Arbeitsvertrag, Regeln zu seiner Erstellung und die Bezeichnung seiner Parteien. Zusammengestellt werden auch unabdingbare Bestandteile, die ein Arbeitsvertrag enthalten sollte. Die Analyse der Texte erfolgt sowohl auf rechtswissenschaftlicher als auch auf sprachlicher Ebene. Die Ergebnisse der Untersuchung ermöglichen, Fehler bei der Übersetzung des Arbeitsvertrags für das Sprachenpaar Deutsch-Polnisch zu vermeiden.

The paper contains a parallel text analysis of German and Polish contracts of employment. The aspects of interest in the research also include legal norms concerning contracts of employment in both legal systems, the regulations pertinent to how such contracts should be drafted and how the parties are named. A list has also been prepared of necessary components which the contract in question should contain in both languages. The selected parallel texts have been analysed at the legal and linguistic level. The results of the analysis should make it possible to avoid errors in translation of employment contracts to German and to Polish.

Artykuł zawiera analizę tekstów paralelnych umowy o pracę w językach niemieckim i polskim. Badaniu zostały poddane także unormowania prawne dotyczące umowy o pracę w obu systemach prawnych, zasady formułowania umowy oraz nazwy stron umowy. Zestawiono również elementy konieczne, które powinna zawierać przedmiotowa umowa w obu językach. Teksty paralelne poddano analizie zarówno na płaszczyźnie prawnej, jak i językowej. Wyniki badania umożliwią uniknięcie błędów podczas tłumaczenia umów o pracę z języka niemieckiego na język polski i z języka polskiego na język niemiecki.

Celem niniejszego artykułu jest przedstawienie ochrony trwałości stosunku pracy w Niemczech oraz zarysu systemu prawa pracy panującego w Niemczech, jednocześnie próba odpowiedzi na pytanie, jakie są podstawy/przesłanki co do zasady przedmiotowej ochrony. Samym przedmiotem mojej analizy są zasady ochrony trwałości stosunków pracy nawiązanych na podstawie umowy o pracę. Stosunki pracy, które mają swoją genezę w mianowaniu, oraz ich cechy charakterystyczne pozostają poza obszarem tego artykułu, ponieważ wymagałoby to znacznie obszerniejszego opracowania.

The aim of this article is to present the protection of the permanence for the employment relationship in Germany and to outline the labor law system prevailing in Germany, as well as attempt to answer the question what are the grounds / prerequisites as a rule of the subject protection. The subject of my analysis are the principles of protection for he permanence of employment relationships established on the basis of a contract for the employee. Labor relations that have their origins in the appointment, and their characteristics remain outside the scope of my article, because it would need a much extensive study.
