Angelo Antonio Frari, a 19th century doctor and writer, devoted his life to studying the plague. In his treaty entitled Della peste published in Venice in 1840, he presented the history of the plague pandemic, describing its symptoms and ways of curing throughout centuries. His work is not only a medical, anthropological, and ethical treaty, but also an account of events seen by a witness, who, having recovered from the plague, became involved in fighting with this disease in Italy and abroad. The author of the treaty delves into pondering on human nature, morality, and choices, and he presents various attitudes in the light of the epidemic. This work is also a source of information on how 19th century healthcare used to work and contains tips on how to avoid catching the disease. The subject matter of the treaty is still up to date, since the last word of this disease has not been said yet and it continues to be a threat to the human race.

The subject of the opinion is the Treaty, including the relationship thereof with other documents devoted to economic management in the European Union (EU). In the author’s opinion, the scope of the subject matter of the Treaty is not a part of the exclusive competencies of the EU. However, the use by the Member States of the so-called Schengen method while concluding the Treaty violates the principle of loyal co-operation. This principle also constitutes an obstacle to the participation of EU institutions in the process of the application of the Treaty, the use by the parties of the rule of the so-called reversed qualified majority and the settlement by the European Court of Justice of disputes between the Member States being parties to the Treaty.

Niniejszy artykuł ma na celu omówienie podstawowych problemów uregulowanych w Europejskim porozumieniu o głównych śródlądowych drogach wodnych o znaczeniu międzynarodowym (AGN). W pracy zaprezentowana zostanie definicja umowy międzynarodowej oraz zostaną wskazane cele Porozumienia AGN, wypracowanego w ramach prac Europejskiej Komisji Gospodarczej Organizacji Narodów Zjednoczonych (UNECE). Ponadto, w pracy zostanie dokonany syntetyczny opis struktury Porozumienia AGN.

The purpose of this article is an attempt of describing the fundamental issues regulated by the European Agreement on Main Inland Waterways of International Importance (AGN). The paper analyzes the definition of international agreement functioning in public international law, as well as it presents the objectives of the AGN Agreement, worked out by the United Nations Economic Commission for Europe (UNECE). In addition, in the paper will be presented a synthetic description of the structure of the AGH Agreement.

Nuclear Weapons Non-Proliferation Treaty (NPT) of 1968, as one of the most important disarmament issues, has awoken controversies since its initial phase. The author of the article on the eve of the new NPT review conference has reminded the past misunderstandings and today’s problems as well as the last six consecutive review conferences. Undoubtedly among remarkable achievements of the conference one can include the development and adoption (in 2000) of arms control and disarmament programme by nuclear powers. Its core is formed by: increasing transparency in nuclear weapons potentials as voluntary means of confidence building measures, decreasing the role of nuclear weapons in security policy and military planning, engaging nuclear powers in multilateral disarmament talks as soon as possible. Finally, the author wonders if the consolidation of non-aligned states, unsatisfied with the passive attitude of nuclear powers, will not influence the treaty in a negative way. If the non-aligned states decided to leave the NPT regime, it would undermine the very sense of the treaty. That would cause irreversible harm to the NPT regime just at its seventh review conference.

Istotnym czynnikiem kształtowania sytemu prawnego niezależnego państwa demokratycznego jest określenie miejsca jego zobowiązań międzynarodowych w krajowym systemie prawnym. Prawo międzynarodowe wiąże państwa, które są zobowiązane do przestrzegania jego norm regulujących ich współpracę w ramach społeczności międzynarodowej. Należy zatem odnieść się do problemu stosunku prawa międzynarodowego do prawa wewnętrznego, poddając analizie uregulowania ustawodawstwa Ukrainy i zawartych przez nią konwencji międzynarodowych. Przedmiotem analizy są przepisy Konstytucji Ukrainy z 1996 r. i ustawy o umowach międzynarodowych Ukrainy z 2004 r. oraz postanowienia Konwencji wiedeńskiej o prawie traktatów z 1969 r., do której w 1986 r. przystąpiła Ukraińska Socjalistyczna Republika-Radziecka i której stroną jest obecnie Ukraina.

An important factor in shaping the legal system of an independent democratic state is to define the place of its international obligations in the domestic legal system. International law binds states that are bound by its norms governing their cooperation within the international community. Therefore, it is necessary to refer to the problem of the relation of international law to internal law by analyzing the regulations of the Ukrainian legislation and the international conventions concluded by it. The subject of the analysis are the provisions of the Constitution of Ukraine of 1996 and the Act on International Agreements of 2004 as well as the provisions of the Vienna Convention on the Law of Treaties of 1969, to which the Ukrainian Soviet Socialist Republic acceded in 1986 and to which Ukraine is now a party.

The United Nations Convention on Contracts for the International Sale of Goods (the so-called Vienna Convention, CISG) is considered one of the most important and influential private law acts of the past decades. The most compelling evidence of the impact of the CISG is the European private law. It is especially evident in case of consumer sales law of the European Union. The Consumer Sales Directive (99/44) and, to some extent, even the Directive on Consumer Rights (2011/83/EC) were based on principles and institutions derived from the CISG. The most important influences are of course the objective liability of a debtor and the institution of conformity of the goods; however, even the basic terms (such as “conformity of goods” and “non-conformity of goods”) are defined per analogiam. And even though European legislator did not borrow from the CISG its’ concept of the fundamental breach of contract, the further cases of CISG’s impact are seen in cases of Nachfrist and remedies available to the parties of a contract. Since European consumer sales law is one of the most important spheres of EU interests and influences national civil law systems, CISG may easily be described as the model and backbone of future private law harmonization.
