The lay judge upholds the law while fulfilling a controlling role in relation to the court. His voice in the court hearing plays an important role in the Polish justice system. He represents the voice of the public in front of criminal, family or labour and social security courts. This role has been established by constitutional provisions and has been fulfilled by lay judges elected according to law until today. In practice, there are negative votes on the functioning of the institution of the lay judge, which are aimed at its elimination from social life. This is not a fully appropriate position, as lay judges serve as a link between the courts and the public and increase confidence in and support of their activity through their participation in a court hearing.
