The author of the opinion claims that heads of provincial sanitary inspections cannot be considered as employees “serving” provincial governor within the meaning of Article 268a of the Code of Administrative Procedure. That interpretation is supported by the wording of Article 19 of the Law on Provincial Governors. According to the author, since the legislature pointed out in a separate provision, in what situations and whom the provincial governor may authorize to exercise his powers, it must be assumed that in other situations such authorization is not permitted. That interpretation is also consistent with the principle of constitutional legality which is the fundamental principle of administrative law. The author gives a conclusion that the province governor cannot authorize provincial health inspectors to conduct, on his behalf, administrative enforcement of non-cash obligations related to preventive vaccination.

The aim of this article is to verify the hypothesis, that Gareth Morgan's theory – a metaphorical approach to the organization, is useful to characterize of a governmental organization, whose activities are subject to restrictive legal regulations and formalized procedures. The model is the State Sanitary Inspection – an organization – an institution operating in the field of public health.

The article contains an analysis of the tasks implemented by the State Sanitary Inspection in the area of public health. The main responsibility of the inspection is first of all to maintain the proper level of sanitary safety in the country. The implementation of this task determines the scope of competences of the State Sanitary Inspection and its internal structure, which were described in the present article. The State Sanitary Inspector is also a state authority within the structure of the state administration that performs tasks under the specific legal regime of the state of epidemics.

Artykuł zawiera analizę zadań realizowanych w obszarze zdrowia publicznego przez Państwową Inspekcję Sanitarną. Naczelną odpowiedzialnością Inspekcji jest przede wszystkim zachowanie właściwego poziomu bezpieczeństwa sanitarnego kraju. Realizacja tego zadania determinuje zakres kompetencji Państwowej Inspekcji Sanitarnej oraz jej wewnętrzną strukturę, które to zostały opisane w publikacji. Państwowy Inspektor Sanitarny to także kluczowy organ w strukturze administracji państwowej, która wykonuje zadania w ramach szczególnego reżimu prawnego stanu epidemii.
