The article is about performance IMMACULATE (2020) by Casey Jenkins focused on problems of queer reproduction. The artist intended to live stream an act of self-insemination every month during ovulation until conception. The author provides critical analysis and interpretation of the performance in the context of pretence and authenticity of the artist’s actions. Flowingly, the author discusses deliberate blurring of boundaries between artist’s life and art, between human reproduction and artistic creation, and explains the relationship between process of creation and its artwork. Finally, the author discusses possible objections to IMMACULATE including issue that a child may be conceived as an artwork. The core of this controversy starts from welding of art creation and procreation. However, resigning from real insemination does not have to undermine the authenticity of art performance or it can make it even more authentic. The author emphasizes the moral aspect of artistic decision-making either in the context of authenticity of art creation or the relational dimension of art where any artistic action taken towards other humans is significant.

Twórczość artystyczna a reprodukcja człowieka Artykuł dotyczy performansu Niepokalana (2020), w którym australijska artystka Casey Jenkins podjęła tematykę queerowej reprodukcji i rodzicielstwa. Artystka zmierzała do samozapłodnienia przy użyciu nasienia od dawcy, transmitując performans na żywo. Proces miał być powtarzany co miesiąc w zależności od dnia owulacji aż do poczęcia. Autorka artykułu dokonuje krytycznej analizy i interpretacji Niepokalnej w kontekście udawania i autentyczności działań artystki. Następnie autorka omawia problem zacierania przez artystkę granic pomiędzy jej własnym życiem a sztuką, pomiędzy prokreacją a działaniem artystycznym oraz wyjaśnia związek pomiędzy procesem twórczym a jego wytworem. Finalnie autorka omawia możliwe zastrzeżenia w stosunku do Niepokalanej, w tym kwestię poczęcia dziecka jako dzieła sztuki. Sedno kontrowersji tkwi w utożsamieniu procesu tworzenia sztuki i prokreacji. Autorka stawia hipotezę, że rezygnacja z prawdziwej inseminacji nie musi jednak podważać autentyczności performansu, a nawet może wzmocnić jego autentyczność. Autorka artykułu dowartościowuje moralny aspekt decyzji artystycznej, zarówno w perspektywie autentyczności twórczości artystycznej, jak i w kontekście znaczenia działań artystycznych dla człowieka oraz relacji pomiędzy osobą artysty a publicznością.

Rozprawka niniejsza opisuje główne założenia i problemy młodzieńczej pracy Georga Lukacsa „Historia i świadomość klasowa” ze szczególnym uwzględnieniem kwestii rewolucji. Autor koncentruje się przede wszystkim na paradygmatycznym przedstawieniu zagadnienia nie wdając się w analizę historycznych kontekstów tej problematyki. Ten punkt widzenia z kolei w naturalny sposób odsyłać musi do zagadnień stricte filozoficznych takich jak pojęcie „filozoficzności” marksizmu, krytyka pozytywistycznego dziedzictwa problematyki teoriopoznawczej z kontemplacyjnym pojmowaniem procesu historycznego, rola podmiotu w dziejach, wpływ metodologii nauk przyrodniczych na metodologię badań społecznych. Na tle tej problematyki pokazujemy dalej możliwość zmiany społecznej – czyli systemowej rewolucji.

In this paper I aim to examine the implementation of the Marxian programme of intellectually transcending the “philosophicity” of philosophy by the Hungarian Marxist, Georg Lukács. I will analyse the book by Lukács, History and Class Consciousness, which I regard to be the best example of a non-philosophical interpretation of Marxism. This fact is the source of the legend of this book, a legend that attributes to the fieriness of revolutionary enquiries as the direct expression of a particular, equally revolutionary historical situation. Let us consider the book, however, not from the point of view of its legend, but from the angle of its current, contemporary content. ‘Commodity fetishism’ is doubtlessly the most important problem to which Lukács devotes much of his attention in this book. All the remaining contents of the book, in fact, result from analysis of this central problem. In particular, the question of subjective-objective identity, with all the consequences it has for the revolutionary movement, directly stems from description of the phenomenon of commodity fetishism and alienation. Let us note that Marks`s thought proceeded along similar lines, recognizing reification and alienation as the social basis for divisions into being and thinking, theory and its object, etc.

Indagacja naukowa dotyczy oceny nałożenia na podmioty niepubliczne prowadzące młodzieżowe ośrodki socjoterapii obowiązku utworzenia szkoły w ramach ich struktury organizacyjnej, w wyniku zmian wprowadzonych przepisami ustawy z dnia 20 lutego 2015 roku o zmianie ustawy o systemie oświaty oraz niektórych innych ustaw. Podstawę prawną określenia, w jakim stopniu oddziaływania socjoterapeutyczne przynoszą pożądane efekty w odniesieniu do młodzieży i instytucji socjalizacyjnych, stanowią aktualnie obowiązujące przepisy ustawy z dnia 7 września 1991 roku o systemie oświaty oraz rozporządzenie Ministra Edukacji Narodowej z dnia 2 listopada 2015 roku w sprawie rodzajów i szczegółowych zasad działania placówek publicznych, warunków pobytu dzieci i młodzieży w tych placówkach oraz wysokości i zasad odpłatności wnoszonej przez rodziców za pobyt ich dzieci w tych placówkach. Generalnym celem postępowania pedagogicznego winna być zakończona sukcesem socjalizacja nieletnich, która przyczynia się nie tylko do ich uspołecznienia i integracji ze wspólnotą ale również, na nieco ogólniejszym poziomie, do jednolitości norm i wartości koniecznych dla spójności całego społeczeństwa.

The legal basis of determining in to what extend the socio-therapeutic actions result in desired effects with regard to the youth and social institutions, constitute the now in force legal rules of the act of law of 07.09.1994 about the Education System and the legal rules of the decree of the Ministry of National Education of 02.11.2015 about the types and the detailed rules of the public institutions, conditions of residence of the children and the youth in such places and the rules and the amount of the payment made by the parents for the stay of their children in those centers. The general aim of the pedagogical behavior should be a successful socialization of the youth, which results not only in their socialization and integration with the community, but also, on a more general level, in homogeneity of norms and values necessary for the unity of the whole society.

The scientific research concerns the evaluation of imposing on non-public persons running of socio-therapeutic youth centers, the duty of establishing a school within the scope of their organizational structure, as a result of changes introduced according to the act of law of 20.02.2015 about the change of the law of school system and some other laws. The legal basis of determining in to what extend the socio-therapeutic actions result in desired effects with regard to the youth and social institutions, constitute the now in force legal rules of the act of law of 07.09.1994 about the Education System and the legal rules of the decree of the Ministry of National Education of 02.11.2015 about the types and the detailed rules of the public institutions, conditions of residence of the children and the youth in such places and the rules and the amount of the payment made by the parents for the stay of their children in those centers.
