Consular law is a set of norms governing the establishment of consular relations and opening consular offices of another state. This is a branch of law that is not unambiguously classified, falling both under international law and national law. It is a highly consolidated, incorporated, and also a recently codified branch of public international law in which the international element undoubtedly dominates. Under the surface, however, one can find more or less highly developed national legislation (German consular law, Italian consular law) which is not a mere concession to international legal norms (especially the Vienna Convention on Consular Relations) but are often separate sets of norms, collected into other directly related, linked to or even closely related national legislation. Given the functions performed by the consular post and the organisational integration of consular authorities into the system of state bodies, it is subsequently possible to classify national consular law into the branch of administrative law.

The judicialisation of international law is a relatively recent phenomenon that gained momentum in the 1990s and 2000s. Coupled with the trend towards widespread compulsory jurisdiction, it has been crucial in strengthening the commitment of states to adhere to their international obligations. Another important effect of judicialisation on international law is that at least certain international norms have acquired an “objective” nature, detached from the will of states. This is because the interpretation and application of these norms is no longer dependent solely upon the subjective discretion of states, but is subject to consideration and examination by independent judicial bodies. The process of judicialisation, while contributing to the international rule of law, has undoubtedly changed the face of international law a great deal as a result of some other factors. The multiplication of international courts has led to the expansion of the judicial institutional layer, making international law less horizontal. Also, as a result of the growing case-law of these courts, the system of international law is becoming more complex and developed, and thus also more mature. The natural aspect of the judicial function is the development of international law. Despite the problems and risks involved, the proliferation of international courts and tribunals can be perceived as one of the important components of the dynamic transformation of international law during the recent decades.

The essay presents the issue of the principle of self-determination from the perspective of international human rights law. The author highlights the close relationship between the principle of self-determination and the principle of respect for human rights and fundamental freedoms. In practice, the principle of self-determination is a prerequisite for the effective guarantee of human rights, and, at the same time, guaranteed protection of human rights is a prerequisite for implementing the principle of national self determination. The author presents the issue of self-determination in the context of the basic regulations of international human rights law, considering regulations of both a ‘hard’ and ‘soft’ law character.

The purpose of the article is to assess how the provisions resulting from international programmatic norms in the field of human genetic data are implemented. The presented study, adopting the perspective of institutional rationalism extended to the paradigm of legalism, considers examples of the implementation of these standards in selected legal systems – Germany, the United States of America and France. The selection of the research paradigm is preceded by a theoretical introduction, which presents three ways of conceptualizing the notion of soft law in the legal sciences. Following an outline of this legal regime in positivism, and the theories of rationalization and constructivism, the author focuses on the provisions of the International Declaration on Human Genetic Data of 16 October, 2003, which are compared with the legislative initiatives of Germany, the United States of America and France, to show the influence that the choices of states has on selection of the implemented standards and how they are implemented.

Poland has been a party to the International Covenant on Civil and Political Rights of 16 December 1966 for forty years, and has been recognizing the right of individuals to submit applications to the Human Rights Committee for 25 years. The total number of communications amounts to 11, and the results of the examination thereof encourage consideration of denouncing the Optional Protocol to the International Covenant on Civil and Political Rights of 16 December 1966.

This article was made after reading the monograph of Professor Richard Skarzynski ‘Anarchy and polycentrism. Elements of the theory of international relations’. The author put in his book the question: ‘Is the theory of international law characterized by many contradictions or even erroneous propositions, because erroneous perception of internationally reality by its creators?’. Exemplification of contrary assertions of empirical experience in international law is, for example, the principle of equality of states. The doctrine of international law increasingly recognizes that the development of international law – by agreement or law-making activities of bodies such as international organizations – the principle of equality of states does not reflect the actual relationship. Skarzyński indicates that the consensus in international relations is complicated by the fact that there is no uniform concept of a peaceful arrangement of these relations, as there is no compatible conception of the state, nation, and the different civilizations use the multiple concepts and are based on different values. It seems that apart from differences of definition, different ideas of political and social institutions in a polycentric world, particularly troublesome is the inability to develop a global ethics. Ethics is after all a factor in determining the final shape of legal norms. The organization of the human species implies a lack of uniformity of international law. Uniformity can at best be partial and bottom-up, for example by agreement of the Member Agreement, or from above, i.e., imposed by force by other countries.

On 1 March 2020, Professor Andrzej Wasilkowski died. In his research, Professor Wasilkowski undertook issues which were co-creating the mainstreams of legal debatesall over the world. He was an author of valuable publications on the relationship between international law and Polish domestic law. Professor Wasilkowski was also a director of the Institute of Law Studies of the Polish Academy of Sciences and the head of the Legal Advisory Committee of the Minister of Foreign Affairs.

The aim of the article is to provide an overview of the achievements of selected representatives of Poznań studies on international law, whose writings have been published in the previous volumes of the Ruch Prawniczy, Ekonomiczny i Socjologiczny [Journal of Law, Economics and Sociology]: Bohdan Winiarski, Alfons Klafkowski, Krzysztof Skubiszewski, Bolesław Wiewióra, Jan Sandorski, Jerzy Tyranowski, Tadeusz Gadkowski, and Anna Michalska. The article considers a selection of papers representative for the main directions of research conducted by three generations of international lawyers from Poznań's Department of Public International Law. The topics covered are as follows: the relationship between international law and national law, the sources of international law, international river law, international law of armed conflict and international responsibility, the law of international organizations, international protection of human rights, territory and recognition in international law, and nuclear law.

The aim of this article is to define secession through its key elements as well as to find out whether a right to secede does exist in contemporary international law. The article aslo points out different approaches to the problem of legality of secession in international law. Based on legal assessment, secession can be ex post regarded as legal, illegal or neutral. A secesion is illegal when it violates the jus cogens norms, such as the prohibition of threat or use of force. Otherwise it is a legally neutral act, since international law contains neither prohibition of secession nor its permission. A specific case of secession is an internal armed conflict (civil war) between the central government and a rebellious separatist group. The prohibition of threat or use of foce is confined to the sphere of relations among States and thus internal armed conflicts cannot be condemned by international law.

Cieľom tohto článku je definovanie pojmu "secesia" prostredníctvom jeho kľúčových definičných elementov, pri súčasnom náčrte rôznorodosti vymedzenia tohto pojmu v doktríne medzinárodného práva. Taktiež rozoberá právo národov na sebaurčenie z hľadiska jeho vonkajšieho i vnútorného aspektu. Z uvedeného práva ako kogentnej normy medzinárodného práva s pôsobnosťou erga omnes odvodzuje časť teoretikov právo na secesiu. Článok poukazuje na skutočnosť, že zásada teritoriálnej integrity nemôže znamenať implicitný zákas secesie, nakoľko táto zásada platí iba vo vzťahu medzi štátmi a nie medzi štátom a separatistickou entitou. V závere analyzuje diskurz v rámci doktríny medzinárodného práva vo vzťahu k otázke legality secesie a predkládá niekoľko úvah de lege ferenda ohľadom možného budúceho vývoja tohto inštitútu.
