From July 2022, a new act of May 20, 2021, called the Developer Act, has been in force in Poland. Its purpose is to protect the buyer, especially of a living accommodation in houses built by developers, in a situation where the buyer of the future living accommodation pays a significant part of the price and the developer may fail to meet its obligations, e.g. by going bankrupt. The rights and obligations of the developer and the buyer are specified in the act and in the contract called the developer contract. It consists in the developer's commitment to construct the building and transfer the ownership of the built separated living accommodation to the buyer, and the buyer undertakes to pay a certain amount of money on account of the price. It is a consumer contract (B2C), because the developer is always an entrepreneur, and the buyer can only be a natural person (acquiring an apartment).
