Umożliwia właściwe wykorzystanie zasobów istniejących w przedsiębiorstwach oraz pozwala na wszechstronne wykorzystanie mechanizmów planowania strategicznego. Wpływ obowiązujących regulacji prawnych, norm, rozporządzeń oraz standardowych warunków kontraktowych na proces planowania i realizacji przedsięwzięć budowlanych stanowi sedno niniejszego referatu. Obowiązujące akty normatywne i systematycznie przeprowadzana ich nowelizacja zmierza do opracowania przejrzystych zasad, wzorców postępowania, precyzyjnego określania zakresu etapów procesu inwestycyjnego oraz praw i obowiązków jego uczestników.

Economical changes, development of new technologies and organizational structures in construction companies management marks the direction in the way investment process is perceived from the standpoint of process approach. It facilitates proper utilization of resources existing in the company, and allows for comprehensive usage of strategic planning mechanisms. The influence of binding legal regulations, norms, directives and standard contractual conditions on the process of planning and implementation of construction projects is the foundation of this paper. Binding legal normative acts and their systematic amendments lead to working out transparent rules, patterns and procedures, precise definition of stages of the investment process, as well as rights and obligation of its participants.

According to the original wording of the Regulation on the register of land and buildings of 2001, in the real estate cadastre there was one attribute associated with the use of a building structure – its intended use, which was applicable until the amendment to the Regulation was introduced in 2013. Then, additional attributes were added, i.e. the type of the building according to the Classification of Fixed Assets (KST), the class of the building according to the Polish Classification of Types of Constructions (PKOB) and, at the same time, the main functional use and other functions of the building remained in the Regulation as well. The record data on buildings are captured for the real estate cadastre from other data sets, for example those maintained by architectural and construction authorities. At the same time, the data contained in the cadastre, after they have been entered or changed in the database, are transferred to other registers, such as tax records, or land and mortgage court registers. This study is the result of the analysis of the laws applicable to the specific units and registers. A list of discrepancies in the attributes occurring in the different registers was prepared. The practical part of the study paid particular attention to the legal bases and procedures for entering the function of a building in the real estate cadastre, which is extremely significant, as it is the attribute determining the property tax basis.

The author provides an analysis of the issue who should be competent to the notification of the parliamentarian draft bills. The article examines meaning of the notification in different areas of law, particularly international and European Union law. Apart from general remarks on the meaning of notification in the context of principle of loyalty, the analysis shows the character of this institution in connection with the consequences of a breach of the due notification. The author focuses on three main types of the procedure of the notification: notification of the state aid, notification of the technical standards and regulations and notification of the draft legislative provisions falling within the European Central Bank’s field of competence. The analysis shows that there is no complex regulation in polish system of law according to the notification procedure. Due to the need to avoid the problems associated with the breach of the due notification author presents his view on the issue who should notify the parliamentarian draft bills and puts forward a number of arguments supporting the conception of the significant role of the sponsor of the bill in procedure of notification.
