Whereas women are sure of their biological maternity, men can never be fully certain of paternity and instead need to rely on indirect cues to assess whether they are likely to be father of their putative children. According to the psychological literature, men commonly use the information on the resemblance of offspring to self as an indicator of genetic relatedness. It seems, however, that in the absence of such a resemblance, similarity between a mother and a child might be important, because a man has additional reason to doubt his own biological paternity when the child is dissimilar to his partner. This assumption has been verified in two empirical studies.

The paper discusses the current issues on recognition of paternity in the light of children’s rights. It identifies the proper tools necessary for determining paternity and maternity and highlights their growing importance in connection with common migration and free movement of persons in the EU. The issue of establishing the law applicable to the content or the form of declaration of paternity is presented based on judicial practice. 34 E. Adama Mickiewicza The paper describes the relationship between recognition of paternity and the process of establishing citizenship and the conditions that must be fulfilled to obtain legal residence in Poland. The conclusions de lege ferenda call for changes in the acquisition of Polish citizenship by operation of law by a child who has been recognized by a man of Polish citizenship. Currently, this possibility is limited by the annual date on which it is necessary to recognize to change a citizenship of a child by law.

Przedmiotem opracowania jest analiza wpływu dostępności testów genetycznych na ustalenie pochodzenia dziecka od ojca. Niewątpliwie testy genetyczne ustalające pokrewieństwo stały się jednym z najczęściej komercyjnie wykonywanymi testami genetycznymi. Są one przeprowadzane zarówno indywidualnie jak również dla postępowań sądowych. Niewątpliwie powszechność stosowania testów genetycznym w celu wykluczenia pokrewieństwa stało się bardzo częstą praktyką sądową. Ponadto jak się wydaje właśnie z uwagi na fakt, że testy genetyczny dają niemalże pewność w zakresie ustalania pokrewieństwa zmieniono również regulacja kodeksu rodzinnego i opiekuńczego opierając stosunek ojcostwa na pewności co do pokrewieństwa genetycznego. Analizie poddano zarówno regulacje kodeksu rodzinnego i opiekuńczego jak również orzeczenia sądowe w celu wskazania charakteru dowodu z testów genetycznych oraz jego wpływu na ustalenie ojcostwa.

The objective of the study involves testing the influence of accessibility of DNA tests, on paternity determination. Without doubt, DNA tests determining the family relationship have become one of the most frequently performed genetic tests commercially. They are carried out both at individual request, as well as for use in judicial proceedings. Undoubtedly, the common use of DNA tests to exclude consanguinity has become very popular in judicial practice. Moreover, it seems that due to the fact that DNA tests are quite accurate in determining blood relations, the regulations of the Family and Guardianship Code have been changed in order to base paternity on the certainty of genetic relation. The study also involved the regulations of the Family and Guardianship Code as well as judicial decisions in order to indicate the nature of evidence from genetic testing and its impact on paternity recognition.

W artykule przeprowadzono analizę blogów ojcowskich, które są konceptualizacją nowych postaw rodzicielskich, wychodzących poza patriarchalny stereotyp. Leksykalną etykietą „nowego ojcostwa” w internetowym dyskursie jest neologizm tacierzyństwo. Przeprowadzone analizy (lingwistyczno- kulturowe) wybranych blogów pozwalają ukazać zakres semantyczny neologizmu, a ponadto jego relacje (na płaszczyźnie poznawczej) ze stereotypem bazowym ojca. Postawa określana jako tacierzyństwo to ojcostwo opiekuńczo-emocjonalne, które jest efektem zanegowania pewnych elementów stereotypu bazowego (takich cech, jak patriarchalność, autorytaryzm) oraz ich redefinicji (relacje z dzieckiem, metody wychowawcze, cel). Dominantą odczytanego w blogach rodzicielstwa męskiego jest emocjonalność – obca bazowemu stereotypowi i ojca, i mężczyzny, przełamująca autorytarny dystans między tatą i dzieckiem, zmieniająca go w relację partnerstwa, bliskości.

The article analyzes father’s blogs that conceptualize parental attitudes which go beyond the patriarchal stereotype. The lexical label of ‘new fatherhood’ in the internet discourse is the neologism paternity. The performed (linguistic-cultural) analyses of selected blogs have shown the semantic scope of the neologism to, and also: its relations (in the cognitive plane) with the base stereotype of the father. The attitude defined as paternity is caring and affectionate fatherhood, which is the result of negating certain elements of the base stereotype (with its features, such as patriarchalism, authoritarianism) and their redefinition (relations with the child, educational methods). The dominant feature of male parenthood as read out in blogs is emotionality – being alien to the base stereotype of the father and the man, breaking the authoritarian.

W ramach zaprezentowanego opracowania przedstawiono wypowiedzi mężczyzn na temat roli i znaczenia ojca dla rozwoju dziecka, a także emocji doświadczanych przez nich w związku ze stawaniem się ojcem. Ze względu na odnotowaną tendencją wzrostu wieku mężczyzn po raz pierwszy zostających ojcami, do badań zaproszono przedstawicieli tzw. dojrzałego metrykalnie ojcostwa. Materiał empiryczny zestawiono z ustaleniami zawartymi w literaturze przedmiotu.

The paper presents the statements of men on the role and importance of a father to the child development, as well as on emotions they experience when becoming fathers. As the trend of an increase in the age of men who become fathers for the first time can be observed, the representatives of mature paternity in terms of metrical age were invited to participate in the study. The empirical material was juxtaposed with the findings included in the subject literature.

Jednym z fundamentalnych wymiarów ludzkiej egzystencji, mającym doniosły i niezbywalny wpływ na charakter bycia osoby, jest sfera płciowości. Człowiek jednak egzystuje nie sam, tylko w ramach wspólnoty. Społeczne znaczenie płci dotyczy trzech kwestii szczegółowych, takich jak: moralny aspekt przyrostu naturalnego, role społeczne i polityczne oraz kultura. Ludzka płciowość umożliwia przyrost naturalny, który musi uwzględniać zasady moralności chrześcijańskiej. Płeć definiuje sposób wykonywania ról społecznych i politycznych, właściwych mężczyznom oraz kobietom. Dzisiejsze wspólnoty stoją przed wyzwaniem walki z wszelkimi formami dyskryminacji społecznej i politycznej, których przedmiot stanowi płeć. Ponadto kultura powinna sprzyjać nie tylko zachowaniu naturalnego charakteru ludzkiej płciowości, ale także chronić rodzinę jako najwłaściwsze miejsce realizacji macierzyństwa i ojcostwa.

Every society is comprised of individuals; therefore, human sexuality as one of the fundamental characteristics of an individual has its implications in the life of a wider community. They may be divided into three groups: firstly, the moral aspect of the population growth, secondly, the social and political roles and thirdly the culture. The population growth is enabled thanks to human sexuality; nevertheless, it has to take into account the principles of Christian morality. One's sex determines the way one fulfils ones' social and political role as a man or a woman. Contemporary societies struggle with various forms of socio-political discrimination based on one’s sex. Finally, it is a major task for the culture to preserve the natural character of human sexuality as well as to protect families as the optimal environment to fulfil one’s paternal or maternal calling.

Das Geschlecht drückt eine grundsätzliche Dimension der menschlichen Existenz aus. Es ist von der großer Bedeutung. Der Mensch lebt nicht allein. Er existiert im Rahmen einer Gesellschaft. Die gesellschaftliche Bedeutung des Geschlechtes betrifft drei konkrete Themen: den Moralaspekt des Geburtenüberschusses, die politischen und sozialen Rollen und die Kultur. Der Geburtenüberschuss ist aufgrund des Geschlechtes möglich. Man muss aber hier die Regel der Moral berücksichtigen. Das Geschlecht definiert dann die Art und Weise der Verwirklichung der sozialen und politischen Rollen. Die Gesellschaft muss aber heute die verschiedenen Formen der Diskriminierung im Bezug auf das Geschlecht bekämpfen. Zum letzen: die gegenwärtige Kultur muss dem naturellen Charakter des Geschlechtes dienen. Man postuliert auch die Sorge um die Familie als um den besten Ort für die Mutterschaft und Vaterschaft.
