The changes in the broadly conceived criminal procedure which were introduced in recent years refer to the problems which are crucial from the perspective of the protection of human rights, such as the scope of the authority of the services due to operational control which is conducted secretly, the model of the functioning of the public prosecution service or the unlawful acquiring of evidence in a criminal procedure. The evaluation of these changes, conducted by the Ombudsman from the point of view of the constitutional standards of the protection of the rights of the individual is not positive. The new regulations reduce the quality of these standards and they do not contain sufficient guarantees of protection against the arbitrariness of the activities engaged in these terms by the organs of public authority. This phenomenon imposes a particular duty on the courts – which hear criminal cases – to see that the final decision in a criminal case respects the universal standards of the protection of human rights.

Operational control is one of the most important powers of the state police services, including, since 2018, the State Protection Service (Służba Ochrony Państwa – SOP). The analysis of the title issue presented in the article leads to the conclusion that the shape of the operational control, which is a novum in the security service, which is the SOP, does not differ from the solutions used in regulating the operational powers of other Polish services, both in terms of the principles and procedure of applying control operational, and the (technical) ways of using this power in practice.

W pierwszej części artykuł ogniskuje wokół problematyki kontroli operacyjnej, podejmując próbę jej analizy w odniesieniu do przepisów międzynarodowych praw człowieka, prawa konstytucyjnego oraz ustaw regulujących dotychczasowe funkcjonowanie tzw. kontroli operacyjnej. W dalszej części omówione zostały nowe kompetencje, szefa ABW oraz zmiany wprowadzone ustawą do k.k. oraz k.p.k. W końcowej części wyszczególniono ponadto zmiany wprowadzone przedmiotową ustawą do innych ustaw szczególnych (w tym do prawa lotniczego, odnoście dronów oraz prawa bankowego w przedmiocie dostępu do tajemnicy bankowej).

The article focuses on the implementation of new solutions in the field of counteracting terrorism in Poland. In the first part it discusses the issue of operational control, which is analysed in the context of international constitutional law, domestic constitutional law and law on operational control. Further on, it focuses on the new competence of the chief of ABW and the implementation of changes to Polish criminal and criminal procedure law. Last but not, it enumerates the changes to other branches of laws (to name but a few; aviation law in the context of drones and bank law in the aspect of access to bank secret).

Operational control of welding quality is the fundamental element of the entire rail manufacturing process. In practice, real-time systems are used for this purpose. This article features a new method that makes use of fuzzy logic to analyze the data from mechanical tests and from the ultrasound inspection of connections.

Kontrola operacyjna jakości zgrzewania szyn jest zasadniczym elementem kontroli procesu całego procesu technologicznego produkcji szyn. W praktyce do tego celu stosowane są systemy działające w czasie rzeczywistym. W artykule zaproponowano nową metodę, która stosuje logikę rozmytą do analizowania danych pochodzących z testów mechanicznych połączeń oraz inspekcji ultradźwiękowej połączeń.

Kontrola operacyjna jest jednym z ważniejszych uprawnień państwowych służb policyjnych, w tym także od 2018 roku Służby Ochrony Państwa (SOP). Analiza tytułowego zagadnienia przedstawiona w artykule doprowadza do wniosku, że kształt kontroli operacyjnej stanowiącej novum w odniesieniu do służby ochronnej, jaką jest SOP, nie odbiega od rozwiązań stosowanych przy regulowaniu uprawnień operacyjnych innych polskich służb zarówno co do zasad i trybu stosowania kontroli operacyjnej, jak i sposobów (technicznych) korzystania z tego uprawnienia w praktyce.

Institutions fighting organised economic crime in Poland

Economic crime is currently the most rapidly developing form of organised crime in Poland. Numerous institutions, law enforcement and intelligence agencies are involved in combating this kind of crime. They are supervised by Ministry of Internal Affairs and Administration, Ministry of Finance, Ministry of National Defence or, like Internal Security Agency and Central Anti-Coruption Bureau, directly to prime minister. Most of them have full operational, investigative and analytical powers. Conflicting areas of responsibility may cause taking actions by various agencies and institutions against the same perpetrators in the same time. Formally the institution responsible for fighting organised crime is Police. Within Police there is specialised unit – Central Bureau of Investigation of Police which sole responsibility is combating organised economic crime. Nevertheless it cannot coordinate other institutions’ activities aimed at fighting organised crime. National Criminal Information Centre, also placed within the Police structure, should gather all information on every criminal offence recorded by any institution involved in fighting crime. In reality it collect mainly information on Police work effects. NCIC has no powers concerning coordination of crime-related information gathering. It also conduct no relevant analysis of gathered criminal information. On the basis of EU regulation Polish Asset Recovery Office was created within the Police structure. Polish ARO acts as national contact point for international exchange of information on crime-related assets. Within this scope, ARO possess some powers to coordinate activities of other agencies. A need exists to consider carefully the possibilities for changes in the system of institutions combating organised economic crime in Poland. First of all there is a necessity to develop ability to coordinate activities of all relevant institutions, based on integrated data gathering and analytical systems.
