Przedmiotem analizy jest infrastruktura portowa jako istotna kategoria ekonomiczna i prawna, postrzegana w jej wymiarze tak teoretycznym, jak i przede wszystkim praktycznym. Infrastruktura techniczna ma decydujące znaczenie dla sprawnego i efektywnego funkcjonowania portu morskiego i zarządzania nim, determinując możliwości i szanse tworzenia przewag konkurencyjnych przez poszczególne terminale portowe na rynkach usług portowych. W tym kontekście szczególnego znaczenia nabiera problem ogólnodostepności infrastruktury portowej, a w tym kwestie definiowania i interpretowania tej cechy na gruncie obowiązującego prawa i portowej praktyki gospodarczej. Istniejący na gruncie europejskim standard ogólnodostępności infrastruktury portowej nie jest jednolicie postrzegany i realizowany, co rodzi niekiedy szereg implikacji prawnych, ekonomicznych i finansowych. Wynikają one z braku lub też ograniczenia dostępu do infrastruktury na zasadach powszechności i niedyskryminacji użytkownika. Z tego powodu w artykule tym skoncentrowano się na tych głównie zagadnieniach, analizując je na przykładzie polskich portów morskich. Problem ogólnodostępności infrastruktury portowej przedstawiono na tle obowiązujacych w Polsce uregulowań prawnych oraz stosowanej praktyki portowej w zakresie organizacji obsługi statków wchodzacych do portów.

The subject of the analysis is the port infrastructure as an important economic and legal category, seen not only in its theoretical but mainly practical dimension. Technical infrastructure is critical to the smooth and efficient functioning of the any port and its management, determining opportunities and chances of creating competitive advantages by individual port terminals on the open port services markets. In this context, of particular importance is the problem of the port infrastructure accessibility, including issues of defining and interpreting this feature on the basis of existing law and economic practices of the European ports. Existing formula of the common port infrastructure accessibility based on so called European standard is not uniformly perceived and implemented, what frequently raises a number of legal implications as well as a great deal of serious economic and financial problems. They result mainly from a lack of or limited access to infrastructure on the principles of universality and non-discrimination of the users. For this reason, author of this paper has focused primarily on these issues by analyzing them in the Polish seaports which have been taken as an example. Port overall infrastructure accessibility has been analyzed by taken into account the already being in force administrative and organizational measures and procedures regulating the ships entry pattern to the port and their distribution along the existing there accessible piers and wharfs.
