The agricultural land lease represented a primary form of agricultural areas management of the State Treasury. One of the elements of legal protection of the lessee with the aim of securing the durability of production business, and thereby often the survival of the farms after the termination of that relation, is a special form of leased land acquisition. Among the special forms of purchase one can enumerate: a pre-emption right, the right of precedence acquisition, lease with the purchase option and the way of land privatisation provided in the Act of September, 16th 2011. This paper is an attempt to assess these instruments from the point of view of its aim execution. Since it appears that the legal position of lessees is relatively weak and the powers they are entitled to are questionable in practice.

Niniejszy artykuł przedstawia problematykę prawną nabywania gruntów pod drogi. W pierwszej części dokonano przeglądu przepisów i procedur nabywania nieruchomości pod tego typu przedsięwzięcia. W drugiej przeprowadzono analizę, w jaki sposób zrealizowano te zasady na odcinku autostrady płatnej A1.

For many years, there has been an ongoing debate in Poland on road and rail infrastructure. Legislation was passed aimed at accelerating and simplifying the procedures required to construct new roads. This article takes a look at the problematic legal issues involved in acquiring land for the purpose of road construction. The first part reviews the rules and procedures for expropriating property for this type of project. The second part presents an analysis of how these principles were followed for a stretch of the A1 toll road.
