Article concerns the question of the legal status of the President of the Office of Competition and Consumer Protection, which is related to the issues associated with the central government administration authorities. There are ongoing new lines of research taking into account the purpose of the public administration, also in terms of competition and consumer protection. Discussed in the article, issues related to the status of the President of the OCCP on its competence, duties, legal forms of action, the appointment and dismissal, as well as the President of the OCCP in the structure of government administration.

The article explores reasons of the abandonment by the Polish legislator of the public law model of the civil service. The discussed reasons were classified into two categories: normative and non-normative premises. The first group discusses the impact of international law on the activities of the Polish legislator and the disproportionately large number of publications on the doctrine of labor law as compared to the administrative law. In the second category, three groups of impact on the legislator’s activities are discussed, i.e. the political perspective (here: systemic, point-based, and episodic impact), clerical, and social perspectives. In conclusion, a return to public-law solutions is proposed.

According to the author of the legal opinion, the current provisions of the 1936 act, which apply to the Muslim Religious Union, became outdated after the Second World War. This state of affairs was aggravated by the entry into force of the Constitution of the Republic of Poland of 1997 and by the conflict existing within the Union. In the author’s opinion, it should be acknowledged that the situation that has arisen is already ripe for the creation of a new statute in this regard.

The following article refers to the notion of military administration. The cognitive procedure was focused around the definition of “military administration”, and research was focused on recognizing the elementary facts that are related to this notion. The aim of the article is to present and organize the most important methodological approaches that refer to the notion of “military administration”. To achieve this goal, the method of document examination was employed, which made it possible to accumulate, sort, describe and scientifically interpret the issues of military administration. By pinpointing and justifying the problem, a stance was taken in the face of the views of other authors, who considered all the aspects of “military administration”. From a scientific point of view, the topic described below and the attempt at defining the notion of “military administra-tion” can lead to conclusions which have not been a topic of discussion for many years

The aim of the study is to show the mutual relations between the government administration and local government units in the conditions of the COVID-19 pandemic. The article uses the decision-making method in order to analyse the actions taken and the decision-making process. Discourse analysis is used to study the communication process between the government administration and local government administration. To analyse the legal acts adopted during the pandemic, an institutional and legal analysis was used. New, serious challenges related to the COVID-19 pandemic did not change the difficult, tense relations between the local government and the central administration, nor did they weaken the conflict between them. In the period of the epidemic, the current animosities, which had existed even before its outbreak, were reinforced. They were related to the dispute between the omnipotence of the state and decentralist tendencies. Additionally, new discrepancies, resulting from the consequences of the epidemic and radical actions taken in relation to it, arose.

The subject of this article is the importance of new technologies in the process of public communication of the Government in Poland. Public communication is understood as a formal communication, limited to the public sphere, where the emission and reception of a message are based on existing law. This paper presents selected examples of the use of new technologies in the process of communication of the Government in Poland compared to selected model solutions of U.S. federal and state level. The aim of this article is to point out certain issues that require a separate, broader discussion and research.

The article looks at the status of Tripartite Commission for Social and Economic Affairs (henceforth: Tripartite Commission) which plays an important role in social dialogue, as well as relations between business and government in Poland. First, the author describes the current legal status of Tripartite Commission, its members and scope of its activities. Next, he reflects on some aspects of norm collisions related to the Commission’s works.

The article presents changes in the method and scope of data collected and processed about citizens by government administration that have occurred over the last 15 years. During this time, there has been a significant increase in the number of areas in which data is collected, as well as the level of detail of the data itself. The reasons for the changes are the development of technologies for managing large data sets, adapting legislation to EU standards, increasing the number of public benefits and services, and increasing the scope of control and supervision exercised by administrative bodies. The article also presents changes in the methods of obtaining data.

The amendment to both acts, formally force since 1936, concerns the adaptation of their contents to the geographical area of the Polish state, which has been changed after the Second World War. The amendment has no practical legal significance. In the author’s opinion, one should strive to adopt two separate religious statutes on the basis of current legal regulations, rather than introducing changes regarding replacing geographical terms and names of state bodies.

The police as a uniformed service is to carry out many public tasks related to ensuring human safety as well as maintaining public security and order. The range of values protected by the police is the reason why it is in the constant interest of social circles, and its actions are thoroughly analyzed and subjected to numerous evaluations. In a sense, social pressure combined with the nature and weight of the challenges undertaken by the police means that it must, in addition to daily efforts aimed at ensuring the security level, also react to the variability of the situation in which it has to operate. One of the reactions to this state of affairs is a possibility to make transformations not only in the forms and methods of activity but also smaller or bigger organizational changes. Changes are made at various levels of organization of this formation, starting from organizational units operating in the field, and ending with those existing at the central level. Recently, there has been a symptom of separating organizational units from the structure of the Police Headquarters and creating them as separate central structures. The study focuses on the changes that occur and analyzes them as a phenomenon referred to in theory as factual deconcentration. The research aims to answer the question whether the changes are incidental or are a permanent trend in the police force.

Ustawa o ochronie zabytków i opiece nad zabytkami określa formy ochrony zabytków właściwe administracji państwowej oraz samorządom. Artykuł stanowi wprowadzenie do szerszej wykładni przepisów prawnych regulujących formy ochrony zabytków pozostających w kompetencji organów państwowych, którymi są wpis do rejestru zabytków, wpis na Listę Skarbów Dziedzictwa oraz uznanie za pomnik historii.

W artykule poruszono problematykę oceny ryzyka kryzysowego kopalni w ramach systemu zarządzania kryzysowego. Jednym z głównych zadań administracji rządowej i samorządowej jest posiadanie rozwiązań organizacyjnych, prawnych, struktur oraz narzędzi pozwalających na sprawne zarządzanie w przypadku wystąpienia sytuacji kryzysowej. Współpraca kierownictwa i osób decyzyjnych Zakładu Górniczego (ze względu na brak sił i środków własnych do likwidacji różnych zagrożeń na powierzchni terenu wymienionych m.in. w siatkach bezpieczeństwa) z jednostkami ratowniczymi systemu ratowniczo-gaśniczego jest nieodzownym elementem zapewnienia bezpieczeństwa.

The article addresses the issue of crisis risk assessment of the mine within the crisis management system. One of the main tasks of the central and local government is the possession of organizational and legal solutions, structures and tools allowing for efficient management in the event of a crisis event's occurrence. The cooperation of management and decision-making personnel of the Mine (due to lack of own manpower and resources to liquidate various hazards on the surface, enumerated, among others, in the safety nets) with the rescue units of the rescue and firefighting system is an indispensable element to ensure safety.

W artykule przedstawiono problematykę pokonstytucyjnej praktyki ustawodawczej w części dotyczące prawa służby cywilnej. W ocenie autora, polska Konstytucja z 1997 r., wyznacza solidne podstawy funkcjonowania korpusu służby cywilnej oraz jasno określa zasady i cele jego funkcjonowania, którymi są przed wszystkim zawodowe, rzetelne, bezstronne i politycznie neutralne wykonywanie zadań państwa. Przegląd ustawodawstwa po 1997 r. oraz towarzyszącego mu orzecznictwa Trybunału Konstytucyjnego został zaprezentowany w przedziałach czasowych wyznaczonych obowiązywaniem kolejnej pragmatyki urzędniczej służby cywilnej. Zgromadzone, liczne przykłady naruszeń postanowień ustawy zasadniczej w badanym czasie i obszarze pozwoliło na sformułowanie wniosków na temat charakteru i praktycznego znaczenia prawa urzędniczego, a także na ogólną ocenę, że jego budowa (w zgodzie z ustrojowymi wytycznymi) jest zadaniem trudnym, niezrealizowanym wciąż w prawie polskim.

The article presents the issues of post-constitutional legislative practice, in part concerning the law of the civil service. In the author’s opinion, the Polish Constitution of 1997 sets a solid basis for the functioning of the civil service corps and clearly defines the principles and goals of its functioning (which are: professional, reliable, impartial and politically neutral performance of state tasks). The review of the legislation after 1997 and the jurisprudence of the Constitutional Tribunal was presented at intervals determined by the next civil service law pragmatics. The collected examples of violations of the provisions of the Constitution (in the analyzed time and area) allowed for the formulation of conclusions on the nature and practical significance of civil service law. General assessment is that polish civil service law construction (in accordance with the Constitution) is a difficult task, still unrealized in the law Polish.

The necessity of the implementation of the NIS directive resulted in the adoption of solutions and concepts which would regulate the system of cybersecurity in the cyberspace to the Polish legal order. The directive formulates the obligations to ensure cybersecurity of the information systems in the service sectors which have a key meaning for maintaining critical socio-economic activity and thus energy, transport, banking, financial institutions, the health sector, water supplies and digital infrastructure. The act on the national system of cyber-security, which implements the directive, introduces a new concept to the Polish legal order, and thus a key service operator, digital service provider, and defines the organs responsible for cybersecurity, formulating their scope of tasks and mutual relations.

Environment of public administration is built by many subjective and objective elements among which the most important is human being and communities created by him/her. They are the reason of public administration existence which is establish in order to fulfill social needs resulting from the people’s coexistence in communities. The concept of human dignity, consider as normative rule or value which always should be taken into consideration by public administration, is insep­arably linked with the concept of human being treated as an individual or as apart of community. Public administration cannot act where human dignity is violated and is obliged to act when human dignity is in danger. Protection of human dignity should always be fundamental feature of public administration activities.

The following article is an attempt to answer the question if a briskly increasing interest in the concept of creativity being implemented into the practical usage of its instruments in the areas of the activity of pro- quality enterprises. The results of the empirical research allowed to form a range of conclusions concerning techniques of a unique way of thinking. The author is hopeful that paying attention to the wide variety of techniques and branches of its implementation will give practical hints for entrepreneurs and will enrich their knowledge in this domain.

The following article is a trial to get to know the problem concerning the survey on citizens' satisfaction from the rendered services among the offices taking part in the contest of the Polish Quality Prize. The results of the empirical research have enabled us to draw conclusions touching the matter of surveying client's satisfaction in the public administration which is improving quality. The author hopes that directing attention to the range of techniques and methods of the data analysis will give hints to the clerks and enrich their knowledge in the very matter.

The primary burden of tackling the pandemic COVID-19 lies with the state as the entity responsible for protecting the health and life of its citizens. Hence, it can be argued that the focus of the pandemic-induced changes to the Polish legal order was on administrative law, which not only sets out the principles of the functioning of the State as the executive power but also governs the relations between the government, local government and citizens, which had to be significantly modified during the pandemic. It would be impossible to analyse and discuss all the emergency measures that appeared in Poland’s administrative law due to the threats posed by the pandemic. The subject matter of the present study is the analysis of the legal solutions adopted in the Republic of Poland in the sphere of public law in connection with the spread of the virus and particular provisions shaping relationships between the two basic structural branches of Polish public administration, viz. the government administration and the local-government administration. The following part of this study will accordingly be devoted to the analysis of the legislative solution contained in Article 11h of the COVID-19 Act, establishing a legal framework for issuing binding instructions to, among others, the various bodies of local governments, local-government legal persons and local-government organisational entities without legal personality.

In the face of the COVID-19 pandemic, the legislator decided to increase the capacity of public administration to operate. Therefore, the provisions of the special act introduced additional tools for the voivode. As a result, a special type of voivode’s „command” was introduced into the legal system. He can now outsource activities to selected authorities and entities in his voivodeship. The paper attempts to locate this new competence in the catalog of legal forms of the voivode’s activity and an attempt to perform a systemic assessment of the compliance of this instrument with the existing models of administrative law.

W obliczu pandemii COVID-19 ustawodawca podjął decyzję o konieczności zwiększenia możliwość działania administracji publicznej. Wobec tego przepisami specustawy wprowadził między innymi dodatkowe narzędzia dla wojewody. Dzięki temu do systemu prawa wprowadzony został szczególny typ „polecenia” wojewody, mocą którego może on zlecić działania wybranym, kluczowym organom i podmiotom działającym na terenie jego województwa. W pracy podjęto próbę usytuowania tej nowej kompetencji w katalogu prawnych form działania woje wody oraz próbę dokonania oceny systemowej zgodności tego instrumentu z dotychczasowymi modelami prawa administracyjnego.
