The aim of the study is to show discrepancies between the intention of the legislator and the actual functioning of solutions contained in the law on family support and foster care adopted in 2011. The article confronts selected system solutions of the Act on Family Support and Foster Care binding from 2012 on secondary institutional sources as well as research results based on literature sources. Analyzing selected legal and organizational solutions, they showed their unsatisfactory social effectiveness. The biggest problem of the current system of foster care is the failure of the available instruments as the result of the lack of a coordination mechanism and, in part, also the will to introduce them. It is all the more incomprehensible that we have not only well diagnosed needs in terms of instruments for family support and foster care, but also recommendations allowing effectively eliminate systemic dysfunctions by implementing adequate coordination mechanisms.

Objectives: The purpose of the paper is to show the difficulties experienced by the families of persons serving prison sentences, as well as to analyse the possibilities of social assistance and support for families of prisoners in overcoming these problems. Material and methods: This paper is a review of scientific literature and legal documents and shows the scope of assistance provided to prisoners and their families. Results: Families of prisoners are often the subject of research because of their role in the process of rehabilitation and social reintegration of prisoners. Families themselves, however, and especially the problems they experience with the imprisonment of a family member, receive little attention. Conclusions: Families of people committing criminal acts are often dysfunctional families that are struggling with numerous social, emotional, and legal problems, and imprisonment of a family member further intensifies these problems. The analysis carried out in this paper shows that there is a lack of forms of assistance directed specifically to the families of prisoners, and if these families do benefit from the assistance of public institutions, they do so mainly indirectly, through the assistance provided to prisoners and through post-penitentiary assistance in the process of adaptation to life after release from prison.

The article analyzes the situation of violence in the family and its impact on dysfunctional roles of its members. The problem is viewed in the context of sociological data and selected aspects of assistance to the family, such as crisis intervention care. Besides intervention actions, the article discusses recommendations pertaining to basic requirements of effective help in a situation of family dysfunction. The focus of the analysis is on the role of the child in a family experiencing direct and indirect violence, where it plays the role of an observer of the suffering of its close ones. An important issue considered here is that of developmental disorders in a child with experience of trauma and its consequences. Traumatic experiences often go hand in hand with the problems of a child in the role of a witness reporting the situation in the family in order to trigger profession assistance. In connection with this the article also discusses the requirement of conducting professional interviews to investigate the situation in the family, and the necessity of therapeutic interaction with children who are victims of family violence.

Artykuł analizuje sytuację przemocy w rodzinie i jej wpływ na dysfunkcjonalne role jej członków. Problem osadzony jest w kontekście danych socjologicznych, a także w wybranych aspektach pomocy rodzinie, jakimi są na przykład działania dotyczące interwencji kryzysowej. Obok nich w artykule wymienione są wskazania dotyczące podstawowych wymogów skutecznej pomocy w sytuacji dysfunkcji rodziny. Analiza skupiona jest również na roli dziecka w rodzinie doświadczającego przemocy bezpośredniej i pośredniej, odgrywającego rolę obserwatora cierpień bliskich. Ważnym wątkiem rozważań jest także wskazanie na zaburzenie rozwoju dziecka doświadczającego traumatycznych przeżyć i konsekwencji z tym związanych. Obok traumatycznych przeżyć lokowane są także problemy dziecka w roli świadka relacjonującego o sytuacji w rodzinie w celu uruchomienia profesjonalnej pomocy. W związku z tym treść artykułu odnosi się także do wymogów profesjonalnego prowadzenia wywiadów mających służyć badaniu sytuacji w rodzinie, a także do konieczności oddziaływania terapeutycznego na dzieci będące ofiarami przemocy.
