In the resolution of 23 January 2020 issued by incomplete three Chambers: Civil Chamber, Criminal Chamber and Labour Law and Social Security Chamber, the Supreme Court made an attempt at categorising judges into those authorised to pass judgments and those unauthorised, as well as judges whose judgments passed prior to issuing the resolution are considered defec- tive. The Court issued the resolution in controversial circumstances, that is in the conditions of proceedings suspended only a day earlier and with no legal basis in the material law, thus interfering in the competences of the executive power and the prerogative of the President of the Republic of Poland. Therefore, the resolution is not a judgment of a Supreme Court and bears no legal effects.
