Immersed in the world dominated by pragmatism, contemporary man seems to be thinking and functioning only according to the criteria of effective acting. However, life experience, philosophical reflection, and the truth of Revelation lead to the conclusion that the laws of nature must be respected in the name of care for man and for one’s genuine good, even though they may, in certain cases, limit the effectiveness of acting and the possibility to acquire current profit. This article justifies the necessity to respect natural law in the sphere of transmission of human life. The starting point of this scientific reflection is the theological vision of values and of the inviolability of human life on the basis of the description of creation from the Book of Genesis. The fundamental truths and moral norms are being neglected nowadays as—being so proud of modern technological achievements—man makes himself the creator and the master of human life. Although such activities seem impressive from the scientific point of view, they actually result in a number of serious contemporary and future threats. The second part of the article presents alarming aspects of artificial interventions in the sphere of life transmission. By exposing the threats and by trying to prevent them in the sphere of infertility treatment, the Church opposes the methods of artificial insemination and becomes engaged in promoting naprotechnology which is a method that expresses genuine humanism, and which gives hope not only to the parents who want to have a baby but also to the mankind that longs for propitious future.

Da una contemporanea sfida nasce l'esigenza di comprendere, fino in fondo, il valore di una parola carica di significato, che si riveste di responsabilità, che ambisce a rappresentare ciò che, con difficoltà si esprime in: fecondazione artificiale. L'articolo presenta l'approccio di Angelo Fiori sul tema della fecondazione artificiale raccolto in due filoni. Il primo filone inserisce l'argomento della fecondazione artificiale con il problema dell’anonimato del donatore. Il secondo vede la fecondazione dal punto di vista legale. Alla luce di quest' indagine risulta che Angelo Fiori è un rappresentante del personalismo, costituendo sempre più importanti contributi all'attuale sullo sviluppo del tema della fecondazione artificiale. Alla luce dei risultati di questa rierca risulta che che Angelo Fiori è a tutti gli effetti un personalista ontologicamente fondato, anche se, le basi del suo personalismo, derivano da ragionamenti di carattere biologico e scientifico, comunque associato ad una chiara ed evidente influenza teologica e filosofica.

A modern challenge is necessity of apprehension of phenomenon and procedures, to learn value of word, it’s completely and meaning, word which is expressed with responsibility and full difficulties in awareness – this word is: artificial fertilization. Author of article concentrates on Angelo Fiori’s mental concepts concerning artificial insemination and it can be classified into two theories. The first one is about problems of donor’s anonimity in procedure of artificial insemination. The second one – it concerns legal context. In analysis Angelo Fiori is a representative of personalism, and his contribution to the current development on artificial insemination are very important. Furthermore, this analisis create Angelo Fiori a personalist, in ontological meaning, even if the theses of concept of his personalism are derived from biological and scientific reasoning, however, associated with a clear and obvious influence of theology and philosophy.

Wyzwaniem dla współczesnych ludzi jest konieczność właściwego zrozumienia zjawiska i procedury sztucznego zapłodnienia, a także wartości i sensu tego pojęcia. Artykuł przybliża naukowy dorobek Angelo Fiori w zakresie sztucznego zapłodnienia. Są dwa istotne problemy. Pierwszym jest anonimowości dawcy w procedurze sztucznego zapłodnienia. Drugi dotyczy kontekstu prawnego. Analizując teksty Angelo Fiori zauważa się jest on przedstawicielem personalizmu, uzasadnionego ontologicznie, opartego na wiedzy biologicznej a wyjaśnianego przy pomocy teologii i filozofii.

The influence of different extender osmolality levels and the presence of different cryoprotectants on the post- thawed semen's characteristics and post-thawed plasma membrane integrity of ram spermatozoa were studied. Ram semen was frozen with TRIS-egg yolk based extender according to two-step dilution procedures. The final concentrations of the cryoprotectants: 6% glycerol, 6% 1,2- propanediol, 62.5 mM sucrose, and 62.5 mM trehalose were studied in three different extender B osmolality levels (350, 375, and 400 mOsm). The osmolality affected significantly the post-thawed semen's motility, defected acrosomes (DA), total morphological defect (TMD), along with the sperm's plasma membrane integrity (HOST). Type of cryoprotectant exerted significant effect (P<0.001) on the post-thawed semen's motility, DA, TMD, and HOST. There was a significant interaction between the osmolality and cryoprotectant on the post-thawed motility, DA and TMD, but not on the HOST. In general, post-thawed motility, acrosomal, morphological, and membrane integrity of the semen frozen with semen extender at 400 mOsm were better than those of 350 and 375 mOsm, regardless of the type of cryoprotectant. Glycerol and 1,2- propanediol, compared to sucrose, trehalose, and control groups, did not protect the post-thawed acrosome and morphological integrity, though it did protect motility and HOST. It was concluded that glycerol based extenders with a high osmotic pressure (400 mOsm) was a better choice for ram semen freezing compared to sucrose, trehalose, and cryoprotectant free extenders. The detrimental effect of glycerol on DA and TMD could be overcome by combining glycerol with sugars and by increasing the osmotic pressure of the extender used for semen cryopreservation. Further research on the cryopreservation of ram semen should focus on the extender osmolality and combination of different cryoprotectants.

Techniki te umożliwiają i promują współczesne trendy społeczne, które prowadzą do oddzielenia rodziny od jej biologicznych podstaw. W związku z tym może wydawać się, że rodzina powstaje na mocy aktu woli dojrzałego człowieka, nieuwzględniającego biologii. Niniejszy artykuł rozważa trzy najnowsze filmy dokumentalne wykonane przez amerykańskie Centrum Bioetyki i Kultury, na które składają się wywiady z dziećmi zrodzonymi z ofiarowanej spermy oraz z kobietami, które dostarczały jaja i podjęły zastępcze macierzyństwo. Celem artykułu jest ukazanie, w jakim stopniu biologiczne po- jęcie rodzicielstwa jest podważane przez te technologie, a także zaprezentowanie ich etycznych oraz antropologicznych konsekwencji. Autor kończy swój wywód, zaznaczając, że wspomniane technologie umożliwiają także osobom wolnym i homoseksualistom „posiadanie" dzieci oraz ostrzegając, że potencjalnymi i rzeczywistymi zgubnymi skutkami takich zachowań będzie spełnianie przez dzieci zachcianek dorosłych.

Artificial reproductive technologies such as sperm and egg donation, in vitro fertilization, and surrogate motherhood all in principle separate the family from its biological foundation. These technologies enable and promote contemporary social trends that disconnect the family from its biological basis and claim that a family is constituted by an act of will, irrespective of biology. The article discusses three recent documentary films made by American Center for Bioethics and Culture, which consist of interviews with children born from sperm donation and women involved in egg donation and surrogate motherhood, to identify how the biological understanding of parenthood is undermined by these technologies and the ethical and anthropological consequences that follow. The author concludes that these technologies are also in principle available to single persons and to homosexuals to enable them to "have" children. He warns that potential and real deleterious effects of such behavior will be satisfying adults' whims by children.

Problems associated with low birth rates have been a long time a societal issue which, in the context of the development of modern biomedical technologies, is closely related to methods of assisted reproduction, especially artificial insemination, which is considered in the discourse to be the only reliable treatment of infertility. However, people don´t talk too much about the fact, that it is connected to many ethical and legal questations about disrespect the integrity and dignity of the human embryo. He is not considered to be the goal of these procedures but only a means of realizing the right to family life or the development of science if he becomes redundant. The aim of this article will be to point to the fact that the current legal situation in reproductive medicine degrades an unborn child into mere biological material or the subject of a contractual arrangement in the form of a surrogate agreement without providing him with adequate legal protection. The related legal concept of anonymous donation then has negative influence on the social life and the development of identity of the individual, who was conceived by using these methods. For this purpose, we will focus our attention on critical analysis of the legislation and we will also point to the need to reconsider the current approach of the legislator, which should proportionally take into account not only the interest of the society but also of every (artificially) conceived child.

Problémy spojené s nízkou porodností jsou již dlouhou dobu celospolečenským tématem, které v kontextu vývoje moderních biomedicínských technologií úzce souvisí s metodami asistované reprodukce, zejména umělého oplodnění, které je v rámci diskurzu považováno za jedinou spolehlivou léčbu neplodnosti. Nehovoří se však příliš o tom, že s jeho realizací je spojeno mnoho etických a právních otázek, které souvisejí s nerespektováním integrity a důstojnosti lidského embrya. To totiž není považováno za cíl daných postupů, ale pouze jako prostředek k realizaci práva na rodinný život či rozvoj vědy, pokud se stane nadbytečným. Cílem tohoto článku bude poukázat na skutečnost, že současný právní stav v oblasti reprodukční medicíny degraduje začínající život na pouhý biologický materiál či předmět smluvního ujednání v podobě surogační dohody, aniž by mu jakožto lidské bytosti poskytoval náležitou právní ochranu. Související zákonná koncepce anonymního dárcovství navíc negativním způsobem navždy ovlivňuje společenský život a osobnostní vývoj takto počatého jedince. Za tímto účelem budeme kriticky analyzovat danou právní úpravu a poukážeme na potřebu celkové změny přístupu zákonodárce, který by měl proporcionálně zohledňovat nejen zájem společnosti, ale také každého (uměle) počatého dítěte.

Mary’s virginity is one of the most problematic dogmas for mentality of modern people. In this context, Church’s objection to using assisted reproduction techniques (in vitro and artificial insemination) which lead to conception of human person without sexual intercourse and – at the same time – the faith in virginal conception of Jesus, seems to be the most difficult issue to understand. This paper will try to answer the question: does the faith in virginal conception stand in opposition to Church’s ban of using techniques of assisted reproduction? And also:does the dogma of Mary’s virginity shed some light on the problem of adequate way of human conception? Moreover, for methodological reasons text will deal with the appropriate interpretation of virginal conception of Jesus because it is the necessary starting point to further analysis.

Dziewictwo Maryi jest jednym z najbardziej problematycznych dogmatów dla mentalności współczesnych ludzi. W tym kontekście szczególnie trudny do zrozumienia wydaje się sprzeciw Kościoła wobec stosowania technik sztucznego zapłodnienia (in vitro oraz sztuczna inseminacja), które doprowadzają do poczęcia osoby ludzkiej bez stosunku seksualnego oraz równoczesna wiara w dziewicze poczęcie Jezusa. Niniejszy tekst spróbuje odpowiedzieć na pytanie: czy wiara w dziewicze poczęcie Jezusa stoi w opozycji do zakazu stosowania technik wspomagania rozrodu formułowanego przez Kościół? A także: czy dogmat o dziewictwie Maryi rzuca jakieś światło na problem właściwego sposobu poczęcia człowieka? Ponadto ze względów metodologicznych tekst zajmie się właściwą interpretacją dziewiczego poczęcia Jezusa, gdyż jest to konieczny punkt wyjścia do dalszych analiz.

Commercially available OptiXcell® extender was compared with conventional extenders for freezability and in vivo fertility of bull semen. Semen was collected from three Friesian bulls for five weeks (replicate) and qualifying ejaculates (motility >60%, concentration >0.5 billion/mL, volume >lmL) were diluted (37°C; 50 x 10⁶ spermatozoa/ml) with OptiXcell®, tris-citric egg yolk and egg yolk-citrate extenders. Diluted semen was cooled to 4°C in 2 hours, equilibrated for 4 hours and filled in 0.5 ml straws. The straws were kept over liquid nitrogen vapours for 10 minutes and plunged into liquid nitrogen. Percentages of post thaw sperm motility and plasma membrane integrity were recorded higher (P<0.05) in OptiXcell® compared to tris-citric egg yolk followed by egg yolk-citrate extender. Sperm viability (%) were recorded higher (P<0.05) in OptiXcell® compared to tris-citric egg yolk and egg yolk citrate extender. Percentages of normal apical ridge and DNA integrity were higher (P<0.05) in OptiXcell® and tris-citric egg yolk extender compared to egg yolk-citrate extender. Higher (P<0.05) fertility rate was recorded with semen frozen in OptiXcell® compared to triscitric egg yolk and egg yolk-citrate extender. In conclusion, OptiXcell® is superior to conventional extenders for spermatozoa) quality of frozen-thawed bull semen and produced higher fertility rates under field conditions.

Zdolność pokonywania ograniczeń stawianych przez naturę często bywa uznawana za miarę postępu. Dzieje się tak również w dziedzinie medycyny, która szczyci się obecnie umiejętnością przezwyciężania wielu naturalnych uwarunkowań ludzkiej kondycji. Znajduje to swoje potwierdzenie chociażby w metodach sztucznej reprodukcji, które są technicznym substytutem prokreacji, proponowanym jako forma rozwiązania problemu niepłodności. Niniejszy artykuł uzasadnia konieczność respektowania norm prawa naturalnego dotyczących przekazywania ludzkiego życia. Punktem wyjścia w podjętej refleksji jest teologiczna wizja prokreacji, nakreślona w oparciu o genezyjski symbol drzewa życia. Zawarte w niej fundamentalne prawdy antropologiczne i moralne znajdują swoje potwierdzenie także we współczesnych realiach, na co wyraźnie wskazują niepokojące skutki uzurpowania sobie przez człowieka pełni władzy nad – zastrzeżonym dla Boga i należącym do sfery sacrum – „obszarem” początków ludzkiego życia. Słuszne dążenie do przezwyciężenia problemu niepłodności, a zarazem szczera troska o przyszłość całej rodziny ludzkiej, rodzi zatem moralny imperatyw rezygnacji z metod sztucznej reprodukcji i wykorzystania osiągnięć współczesnej medycyny i techniki do rozwijania form autentycznej terapii, których modelowym przykładem jest dziś naprotechnologia.

This investigation aimed to study the effect on fertility parameters of one or two artificial inseminations (AI) and the administration (carazalol) before insemination of β-adrenoceptor blocker in Awassi sheep. A total of 144 Awassi sheep with their oestrous synchronized were divided into 4 groups. Group A1 had a single artificial insemination applied at 52 hours after (the sponge was removed), group A2 had a single artifical insemination applied while for preinsemination 0.01 mg/kg carazalol were given i.v. Group B1 had artificial insemination appled twice at 52 and 60 hours. B2 group had artificial insemination appled twice at 52 and 60 hours and for preinsemination 0.01 mg/kg carazalol were given i.v. As a results, the ratios of not observed oestrus after 25 days were 55.6%, 61.1%, 63.9% and 69.4% in groups A1, A2, B1 and B2 respectively. The ratios of pregnancy were diagnosed ultrasonographically after the 30th day of artificial insemination as 47.2%, 50.0%, 52.8% and 61.1% in groups A1, A2, B1 and B2 respectively. The ratios of birth by means of artificial insemination were 41.7%, 47.2%, 47.2% and 55% in groups A1, A2, B1 and B2 respectively. The degree of fertility was found to be higher in the group in which the sheep applied artificial insemination twice with 8 hours intervals and administrated β-adrenoceptor blocker preinsemination. However, the difference between groups was not significant (p>0.05).

The aim of the article is to analyze the freedom of states-parties to the Convention for the Protection of Human Rights and Fundamental Freedoms of 4 November 1950 in the scope of pre- implantation diagnosis and to answer the question of whether or not the Convention includes the “right to a healthy child”. The analysis of the case law, particularly the Costa and Pavan judgment (application no. 54270/10) confirms a praetorian approach of the European Court of Human Rights to the interpretation of the right to the respect of private life, which comprises, i.a., the right to bring a child into the world who is not affected by the illness that the parents carry as well as the right to technical means to realize it, including preimplantation diagnosis. The Costa and Pavan judgment does not determine whether or not Article 8(1) of the Convention grants “the right to a healthy child” or “the right to a genetically healthy child”, but may be a step in the direction to accept it. According to the author, it raises concerns, because it strengthens the basis for the legitimacy of a certain kind of eugenic pratices.

The aim of the study was to evaluate the effect of different concentrations of spermatozoa in insemination dose (ID) on fertility rate of inseminated does, and on the number of all and live-born young per litter in the breed of crossbred rabbits by using certain rates of dilution. The crossbred rabbits of female strain HYPLUS PS 19 and male strain HYPLUS PS 39 were used in the experiment. In the first part of the experiment does were inseminated with ID 0.5 cm3 with the concentrations of spermatozoa from 115 to 550 x 106 in 1 cm3. In the second part of the experiment does were inseminated with the same volume of ID (0.5 cm3), however with the lower concentration, namely from 55 to 150 x 106 in 1 cm3. The particular concentrations of spermatozoa in ID had no statistically significant effect on fertility rate and number of all and live born young per litter in both parts of experiment.

In emus, the duration of the fertile period was measured following a single artificial insemination (AI) and investigated the effect of time of AI in the egg cycle on the duration of the fertile period. Semen was collected by artificial cloaca, pooled and used undiluted for AI within 30 minutes. For insemination, a female was followed until she assumed the voluntary crouch. A speculum was then inserted into the cloaca and an insemination straw introduced into the vagina to a depth of 1-2 cm, and semen deposited. Following a single insemination with 100, 200 or 400 million spermatozoa, female emus laid fertilized eggs for 10.0±0.4, 12.0±0.9, and 15.0±0.6 days. When 400 million spermatozoa were used for insemination on Day 1, 2 or 3 of the oviposition cycle, the duration of the fertile period appeared to change in a day-dependent manner. After AI on Day 1, female emus laid fertilized eggs for 15.8±1.1 days, after AI on Day 2 for 12.5±2.2 days, and after AI on Day 3 for 10.0±1.5 days. The results suggest that female emus need to be inseminated the day after oviposition to maximize the duration of their fertile period.

Celem badań było określenie długości okresu zapładnialności jaj emu po sztucznym unasienieniu i wpływu czasu unasienienia na długość tego okresu. Nasienie pobierano za pomocą sztucznej pochwy I samice unasieniano nierozcieńczonym nasieniem w ciągu 30 minut. Unasieniania dokonywano za pomocą wziernika, po tym jak samica dobrowolnie usiadła i pozwoliła na dostęp do kloaki. Nasienie deponowano dopochwowo na głębokość 1-2 cm ze słomki inseminacyjnej osadzonej na strzykawce. Po jednokrotnym unasienieniu dawką 100, 200 czy 400 milionów plemników samice znosiły zapłodnione jaja odpowiednio przez okres 10±0,4, 12±0,9 i 15±0,6 dni. Po unasienieniu dawką 400 milionów plemników w 1, 2 czy 3 dniu cyklu jajowego, długość „okresu płodnego” wyniosła odpowiednio 15,8±1,1,12,5±2,2 i 10,0±1,5 dni. Wyniki sugerują, że aby uzyskać maksymalną długość okresu zapładnialności jaj emu w trakcie nieśności, unasienienia powinno się dokonywać w pierwszym dniu cyklu jajowego, to jest w dzień po zniesieniu jaja.

b_The right to privacy is considered to be one of the fundamental rights of every person end it is protected not only at the international or constitutional, but also the legal level. In this context, it is possible to rely on the legal provisions of the new Civil Code, which, in several places, provides private protection for the personality of a person. lt is, by its very nature, a fairly broad category, in which we can, in the light of the case law of the European Court of Human Rights, include also the protection of private and family life, including the right to knowledge of origin and the circumstances of birth. It cannot be disputed that this aspect of personality is traditionally a psychological, sociological and legal issue, also in the context of the historically applied adoption system. At present, however, new rules and ethical-Iegal questions in this area emerge, especially due to the emergence of modern biomedical technologies, which are increasingly being promoted in society. This issue is connected also with questions of assisted reproduction and related legislative requirement for the anonymity of gamete donation, which, in our opinion results in a situation in which the state de facto prevents the establishment of family ties and interferences with the right to privacy and personality rights.

a_Právo na soukromí je považováno za jedno ze základních práv každého člověka a je chráněno nejen na mezinárodní či ústavní, ale také zákonné úrovni. V tomto kontextu je možné vycházet rovněž z právní úpravy zakotvené v novém občanském zákoníku, který na více místech poskytuje soukromoprávní ochranu osobnosti člověka. Jedná se již ze své podstaty o poměrně širokou kategorii, pod níž ovšem můžeme s ohledem na judikaturu Evropského soudu pro lidská práva výkladově subsumovat také ochranu soukromého a rodinného života, včetně práva znát svůj původ a okolnosti narození. Nelze zajisté zpochybnit, že tento aspekt osobnosti člověka je tradičním psychologickým, sociologických a také právním tématem, a to v kontextu již historicky uplatňovaného institutu osvojení. V současné době se ovšem ve společnosti čím dál více prosazují moderní biomedicínské technologie, které stanovují zcela nová pravidla a eticko-právní otázky. Jinak tomu není ani v případě asistované reprodukce a souvisejícího legislativního požadavku na anonymitu dárcovství pohlavních buněk, čímž dle našeho názoru ze strany státu dochází nejen k faktickému znemožnění navázání rodinných vazeb, ale také k zásahu do práva na soukromí a osobnostních práv.

In vitro fertilization (IVF) is a method known almost all over the world, by which modern man is trying to cope with the problem of infertility. The aim of this article is to show the eugenic roots of in vitro and to attempt to reconciliate the supporters and opponents of this controversial procedure at a NaProTechnological plane. In order to achieve this, the author characterizes IVF from the technical, medical and legal point of view. Then, the article shows the relationship between the in vitro procedure and eugenic thought. The third section contextualizes the problem of artificial insemination in the contemporary, human uncritical faith in technological progress. The last part of this article directs the reader's attention towards NaProTechnology – a method of infertility treatement which can engage both the supporters and the opponents of IVF.
