Głównym celem artykułu jest wskazanie na rosnącą rolę nowych technologii w realizacji funkcji compliance w organizacjach. Na początku opracowania omówiono definicje oraz podstawowe funkcje compliance. Następnie, opierając się na wynikach dotychczasowych badań przedstawionych w raportach branżowych oraz doświadczeniu zawodowym autora w zakresie realizacji funkcji zarządzania zgodnością w obszarze finansów, przedstawiono aktualny stan wykorzystania rozwiązań technologicznych w realizacji zadań compliance, a także perspektywy rozwoju nowych technologii w zarządzaniu ryzykiem niezgodności i wykrywaniu oszustw finansowych. Zaprezentowane rozważania prowadzą do wniosku, że niestabilność otoczenia prawnego oraz rosnąca odpowiedzialność karna członków zarządów prowadzi do dynamicznego rozwoju nowoczesnych rozwiązań technologicznych w obszarze zarządzania zgodnością oraz raportowania wewnętrznego i zewnętrznego.

The main aims of this paper is to point at the increasing role of new technologies in the realization of the compliance function in organizations. In the first part of the paper, compliance term and basic functions of compliance are presented on the basis of literature review. In the next part, based on research results presented in industrial reports and author's professional experience in implementing compliance management in the financial area, the current state of use of technology solutions in the compliance management systems and the prospects for the development of new technologies in non- -compliance risk management and financial fraud detection are described. The disscuion presented in this paper leads to the conclusion that the instability of the legal environment and growing criminal liability of board of directors members leads to the dynamic development of modern technologies solutions in the area of compliance management as well as internal and external reporting.

Artykuł traktuje o systemie zarządzania zgodnością w sporcie. Rozważane jest czy de lege lata regulacje compliance znajdują zastosowanie w klubach sportowych, co zostaje omówione na przykładzie systemu licencyjnego ustanowionego przez PZPN. Ponadto, przedstawione zostają założenia projektowanej ustawy o odpowiedzialności podmiotów zbiorowych oraz jej wpływ na obowiązki stawiane organizacjom prowadzącym działalność sportową. Pokrótce omówiony zostaje nowy reżim odpowiedzialności klubu sportowego jako podmiotu zbiorowego. Główne tezy: Wprowadzenie systemów zarzadzania zgodnością przez podmioty prowadzące działalność sportową jest pożądane. Regulacje compliance w sporcie przyczynią się do profesjonalizacji sportu. Kluby sportowe powinny przestrzegać takich samych zasad jak inni uczestnicy obrotu gospodarczego. Systemy licencyjne tworzone dla poszczególnych dyscyplin sportowych są elementem budowania sytemu compliance. Projektowana ustawa o odpowiedzialności podmiotów zbiorowych nakłada na kluby sportowe nowe obowiązki z zakresu compliance.(abstrakt oryginalny)

The article concerns the compliance management system in sport. It is considered whether de lege lata compliance regulations are applicable in sports clubs, which is described by the example of a licensing system established by PZPN. In addition, the assumptions of the draft Act on the liability of collective entities and its impact on the obligations imposed on organizations conducting sports activities are presented. The new regime of the liability of sports club as a collective entity is briefly characterized. Main theses: The introduction of compliance management systems by entities conducting sport activities is advisable. Compliance regulation in sport will contribute to the professionalization of sport. Sports clubs should follow the same rules as other market participants. License systems established by sport associations are part of compliance system. The draft Act on the Liability of Collective Entities imposes new compliance obligations on sports clubs.(original abstract)

The scientific literature treats compliance as a way of organising a company to ensure compliance with legal requirements. The effectiveness of the compliance system requires continuous improvement at each stage of the enterprise's operation, constant adaptation to changing business conditions and regulations, especially in the current crisis caused by the pandemic, which has affected the current functioning of the organisation but also the escalation of specific risks. This time is a major challenge for compliance, allowing us to observe new realities as a matter of urgency, analysing needs in order to provide real and not illusory support for corporate governance.(original abstract)

Compliance Systems as a Determinant for the Functioning of Social Responsibility Instruments in an Organization

Purpose: Identifying and demonstrating the determining role of the compliance system in relation to other instruments of social responsibility systems in an organization. Design/methodology/approach: The research method used in the paper is mainly a standardized direct interview with middle- and high-level managers, conducted on the basis of a questionnaire containing both open and closed questions. The research process was also accompanied by: analysis of source documentation, study visits with author's workshops and participant observation. The selection of the surveyed entities was based on the author's professional experience, resulting from cooperation with the surveyed organizations within the scope of legal services. Findings: Research results verify research hypotheses formulated on the basis of the paper's objectives, enabling general conclusions, which are: the compliance system is the main instrument used to prevent violations of not only legal, but also ethical and social norms, it coordinates and integrates social responsibility instruments as part of the general system for corporate social responsibility management. Research implications: Future research directions should focus on further, expanded research exploration in the area of integrating compliance in socially responsible organizations, taking into account various industries and the level of implementation of the instruments of corporate social responsibility. Practical implications: The results of the research discussed in the paper have a number of practical implications, mainly for the management staff, in terms of the use of compliance systems for construction and improvement of corporate social responsibility strategies. Social implications: Building awareness and shaping compliance culture in organizations to improve social responsibility systems Originality/value: The paper has cognitive value for the development of knowledge, science and quality in terms of implementing a new management instrument into management sciences, which is compliance. It also has value for practice in the field of implementation and integration of compliance with existing management systems in an organization.(original abstract)
