Purpose: is to show judicial reporting in relation to the rule of law. The text focuses on the considerations and analysis of the relativity of judicial reporting to the rule of law as a kind of values and subjective rights of civil society. An additional assumption is to indicate the essence of the issue in an interdisciplinary perspective, drawing attention to its importance, multidimensionality, connection and social significance, leaving room for own research. Design/methodology/approach: The research method used in the article is the analysis of scientific studies, supplemented by the author's observations and experience. The research procedure included a review of Polish and foreign literature, an analysis of legal acts and court decisions, a case study and deductive reasoning. The above text evokes, in the author's opinion, a separate understanding and application, more and more commonly, also by journalists, of the concepts of justice, the rule of law and law. Findings: A high level of influence of judicial reporting on the rule of law has been demonstrated. Great demand for this type of message and its values, which should be implemented by the rule of law - judgments of common courts, to be considered the most desirable form of the system. Social development in the face of values as an interdisciplinary concept in terms of direction and field allows you to maintain what is with what should happen in the future. It is important not only what intentions people have, but also what competences they have and according to what values they operate. The conducted analysis shows that the correctness of the message and the understanding of the meaning of the rule of law in the area of law are important and vice versa. An autocratically governed society can be fully governed by law, the courts can issue judgments and the court rapporteurs publicly present them, which does not necessarily mean that we are dealing with the rule of law and the rule of law. Research limitations/implications: Limitations of the obtained results may result from a limited text sample, small text size. Originality/value: The presented research and conclusions provide practical tips not only to people of science, but above all to average citizens, mainly those who are not aware that the world of values surrounds people, but depends on them, what values they pay attention to and to which he remains indifferent. Man has the freedom to choose what suits him best, but is rarely able to use it rationally and in an appropriate form and time. Among values, man does not have to do anything and can do much. The less complex and understandable the forensic message, the closer to the concept of simple principles of human life and action. Every aspect of judicial reporting contributes to strengthening the rule of law in the spirit of a democratic rule of law. The paper starts with a review of literature focusing on links between democracy and environmental protection, pointing out a fair weight of scientific evidence that democratic societies on average enjoy a higher level of environmental quality than autocracies. It subsequently provides a quick insight into the recent trends in the state of democracy and the rule of law in Poland as well as a few examples of measures taken concerning environmental policy that have been undertaken after 2015. The paper concludes by expressing concern about certain negative patterns in the Polish environmental policy in the past few years, which seem to be connected to the deficiencies in the rule of law and democracy as observed in Poland. The shrinking space for civil society to participate in democratic governance concerning environmental issues and the excessive appetite of the current government for large infrastructural investments seem to be in contradiction with the European and global strive for sustainable development and tackling climate change. It remains to be seen if the recent negative trends in the Polish environmental policy will have a structural impact on the state of environment in Poland. (original abstract)

Artykuł ma dwa cele: pogłębienie rozumienia relacji między zasadą rządów prawa i demokracją oraz próbę wyjaśnienia przyczyn kryzysu rządów prawa w Polsce. Napisany został na podstawie badania literatury źródłowej i literatury przedmiotu. W artykule przyjęto interdyscyplinarną perspektywę ekonomii instytucjonalnej. Prezentacja koncepcji rządów prawa ujawnia, że nie ma jednej niebudzącej wątpliwości interpretacji tej zasady. Trudności wynikają z braku jednolitej interpretacji wolności i sprawiedliwości. W ślad za negatywną koncepcją wolności idzie koncepcja rządów prawa, w której akcentuje się konieczność ograniczenia władzy, wagę procedur prawnych i sprawiedliwości formalnej, czyli równego traktowania wszystkich obywateli. Przekonanie o konieczności urzeczywistniania przez państwo sprawiedliwości społecznej prowadzi do rozszerzenia interpretacji rule of law w duchu wolności pozytywnej. Skłonność do interpretacji rule of law w duchu pozytywnej koncepcji wolności jest ważnym źródłem kryzysu rządów prawa w Polsce. Syntetyczne spojrzenie na bieg wydarzeń i spory w Polsce pokazują, że wśród różnych przyczyn kryzysu rządów prawa w Polsce można wskazać także specyfikę sytuacji transformacji, konfrontacyjny styl dyskursu politycznego i proces pomieszania rządzenia ze stanowieniem prawa. W takiej sytuacji podważanie instytucji Trybunału Konstytucyjnego nie jest drogą do uzdrowienia sytuacji, lecz może pogłębiać proces inflacji prawa i oddalać społeczeństwo od drogi reformy opartej na stopniowym doskonaleniu prawa. The aim of this paper is to shed new light on what the rule of law really means in Poland's post-socialist transition. In the first part of the article, we focus on the interpretations of the rule of law principle and its relationship to the democratic principle of majority rule. We highlight two different interpretations of the rule of law that stem from the negative and positive concepts of freedom. In the second part, we look for the causes behind the rule of law crisis in Poland. Referring to the course of Poland's political and economic transition, we refer to the disputes around the Balcerowicz Plan as well as the tendency to interpret the rule of law in light of the positive concept of freedom. We also mention the confrontational style of the political discourse and the process of "legislative inflation." The paper attempts to defend the thesis that undermining the role of the Constitutional Tribunal in such circumstances is not the way to rectify faults in the social system, but it may deepen the "legislative inflation" process, turning Poland away from the path of reform and reconciliation.
