It is frequent to underestimate the influence of non-binding instruments of international law such as resolutions of International Law Institute. In this article, I indicate the great influence of Institute’s resolutions on international family law. It treats on history of the Institute and chosen resolutions taken over last 50 years which influenced on private international law and international family law. I decided to use as an example Polish Private International Law dated on 4th February 2011 and EU regulations related to law applicable to maintenance obligations, divorce and separation and matrimonial property regimes where it is visible how some solutions proposed by Institutes are implemented by local and European legislator.
