Staff evaluation is an integral element of the system of professional development for regulars of all corps. The aim of this paper is to present selected aspects of the evaluation of regular soldiers. The author puts em- phasis on the importance and function of staff evaluation in the context of professional development in both the objective and subjective perspective, the layout of the staff evaluation sheet and its imperfections, responsibility related to the making of honest evaluation, as well as the impact of evaluation results on the career of the evaluated personnel.

Work and career are principal activities of man. They determine major life goals and satisfy developmental needs of every working man. The empirical studies show that a career represents a different value in working people’s life and, therefore, people place a different value on professional aspects. The profession of a soldier is commonly perceived as a difficult and dangerous occupation, it requires following orders by troops and paying attention to keep high quality of military service. The aim of this article is to identify the major work values among military academy students who decide to serve the country. This issue was discussed according to social and professional contexts.

Praca zawodowa stanowi zasadniczą formę aktywności człowieka. Wyznacza cele życiowe i zaspokaja potrzeby rozwojowe każdej pracującej jednostki. Jak wykazują badania empiryczne, praca zawodowa przedstawia różną wartość w życiu pracujących, podobnie jak odmiennie cenione są jej poszczególne aspekty. W zawodach trudnych i niebezpiecznych, do których zalicza się profesję żołnierza zawodowego, znaczenie przywiązywane do wykonywanej pracy odgrywa kluczową rolę w jakości pełnionej służby. W związku z tym autorka opracowania dokonała identyfikacji wartości zawodowych, jakie wiążą z przyszłą pracą słuchacze uczelni wojskowej. Zagadnienie to było rozpatrywane w kontekście uwarunkowań społeczno-zawodowych.

W artykule dokonano przeglądu literatury naukowej na temat wybranych wymiarów wolności człowieka, będącego podmiotem oddziaływania Sił Zbrojnych RP. Artykuł ma na celu zbadanie ich charakteru oraz sposobu wzajemnego powiązania poprzez mechanizmy instytucjonalno-prawne. Ramy koncepcyjne artykułu wytycza zastosowanie koncepcji konsyliencji, użytecznej w analizach działania instytucji publicznych, wykorzystując podejścia z zakresu: polityki, bezpieczeństwa, prawa, zarządzania publicznego, prakseologii, zarządzania zasobami ludzkimi oraz paradygmat funkcjonalno-interpretatywy i umiarkowanego konstruktywizmu. Niniejszy artykuł ukazuje pojmowanie bezpieczeństwa jednostki z perspektywy poszanowania prawnego wybranych wymiary wolności członka sił zbrojnych.

The article reviews the scientific literature on selected dimensions of human freedom, being the subject of influence of the Polish Armed Forces. The aim of the article is to examine their nature and the manner of their interconnection through institutional and legal mechanisms. The conceptual framework of the article is determined by the use of the concept of consilience, useful in the analysis of the operation of public institutions, using approaches in the field of: politics, security, law, public management, praxeology, human resource management and the functional-interpretative paradigm and moderate constructivism. This article shows the understanding of individual security from the perspective of legal respect for selected dimensions of freedom of a member of the armed forces.

The men’s right to parental leave is protected by provisions art. 14 which prohibits discrimination based on sex taken in conjunction of art. 8 which guarantees to everybody the right to respect for private and family life of the European Convention of Human Rights of Nov.4th, 1950 decided the European Court of Human Rights in its judgment of March 12, 2012 in the case of Kostantin Markin v. Russia. An author examines the ECtHR assessment concerning the applicant employed as servicemen in the military of the domestic authorities’ refusal to grant him parental leave because he belonged to the male sex. The Court found in favour of an applicant due to the fact that as parental leave and parental leave allowances are concerned, men are in analogous situation to women. The Court has accepted that the rights of military personnel under various provisions of the Convention may in certain situations be restricted to a greater degree than would be permissible in case of civilians. In respect of restrictions on the family and private life of military personnel there must exist particularly serious reasons. Such restrictions are acceptable only where there is a real threat to the armed forces operational effectiveness. The difference in treatment cannot be justified by reference to traditions prevailing in a certain country. Taking into consideration that in Russia the entitlement to parental leave depends exclusively on the sex of military personnel the ECtHR decided that then exclusion of servicemen from the entitlement to parental leave while servicewomen are entitled to such leave, cannot be said to be reasonably or objectively justified. The Court concluded that the different treatment, of which men denied of the right to parental leave, amounted to discrimination on grounds of sex.

Autor analizuje wyrok Europejskiego Trybunału Praw Człowieka z 22.03.2012 r. w sprawie Konstantin Markin przeciwko Rosja. Mężczyzna, zawodowy żołnierz zaskarżył Federację Rosyjską z powodu odmowy przyznania uprawnień do urlopu wychowawczego, z których mają prawo korzystać kobiety – żołnierki. Trybunał orzekł, ze uprawnienia żołnierzy zawodowych (mężczyzn i kobiet) w sprawach dotyczących uprawnień socjalnych mogą być różnicowane pod warunkiem, że są poważne i uzasadnione obiektywnymi względami, takimi na przykład jak zagrożenie dla zdolności bojowej wojska. W żadnym wypadku natomiast dyferencjacja uprawnień do urlopów wychowawczych nie może być dokonywana ze względu na płeć. Trybunał stwierdził, że w Federacji Rosyjskiej nabycie i korzystanie z uprawnień do urlopu wychowawczego zawodowych żołnierzy jest uzależnione od płci osób wychowujących dzieci. Orzekł, że prawo rosyjskie, petryfikując stereotypowe wyobrażenia o roli kobiet i mężczyzn w społeczeństwie, dyskryminuje mężczyzn – zawodowych żołnierzy. Nie przyznaje bowiem prawa do urlopu wychowawczego, z którego mogą korzystać kobiety odbywające zawodową służbę wojskową. Prawo mężczyzny jest objęte ochroną prawną przepisów art. 18 i art. 8 Europejskiej konwencji o ochronie praw człowieka z 1950 r.
