The article presents the institution of an administrative agreement from the perspec-tive of legal solutions in force in selected European countries. The increase in the number and diversity of tasks performed by the administration and the multitude of conducted proceedings encourage the search for alternative forms of settling a case in relation to an administrative decision. The administrative agreement is one of them. The analysis of foreign regulations confirms that the institution in question belongs to the modern procedural laws. The scope of regulation varies, as do the individual solutions concerning the admissibility and mode of concluding the contract, its subject matter, the mechanisms for removing defects, the grounds for contestability of the contract and its enforceability. It turns out that in individual European orders two patterns of regulation dominate: French and German, although they are subject to significant modifications. The performance of certain public tasks by private parties on the basis of an administrative agreement provides for certain guarantees not only for the parties to the agreement but also for the beneficiaries of those tasks. This particular type of contract allows adequate protection of the public interest. The prevalence of the administrative agreement in Europe prompts the author to formulate a conclusion on the need to include this institution in the home system. The attempt made in the 2017 reform of the Administrative Procedure Code to include in it an administrative agreement was unsuccessful. The provisions on an administrative agreement that were then drafted were intended to give a deeper meaning to mediation, a new institution in administrative proceedings, which is currently not popular. Mediation was to precede the conclusion of an administrative agreement. However, there are no significant obstacles to returning to work on the regulation of this institution, which is so widely used in other European countries, and which is clearly lacking in its home Code

The article attempts to explore the applicability of the household model to the monastery of Bawit in Middle Egypt as seen through the papyrological documentation. By focusing on features and functions of household underscored in definitions used by sociology and economy, it defines the monastery as a unit where material and symbolic value was produced and transmitted, and brings to light connections between people, materialities, and labour.

The article focuses on the attestations of clergy in the Oxyrhynchite archive of the Apion estate. In this group of texts, clerics feature in various roles such as administrators, cultivators, and legal specialists. A close reading of these documents within the context of normative sources and testimonies from outside the Apion archive allows us to come closer to an understanding of the clergy as a socially and economically diverse group poised to play intermediary roles in the networks of a great estate. The various aspects of the profiles of clerics recorded in the texts (wealth, education, skills, place of origin) encourage us to envisage the clerical status as an intersectional experience where symbolic-religious and socio-economic factors remained in constant interplay.

The subject of this study is the issue of the legal nature of the resolutions of the Financial Education Council containing an addressed to the Financial Ombudsman request about the use of the Financial Education Fund in a specific manner. The resolution has significant legal effects because it binds the Ombudsman in the field of spending the funds. Due to the lack of a detailed regulation devoted to the legislative powers of the Council, the admissibility of judicial review of its resolutions raises doubts.

Przedmiotem niniejszego opracowania jest kwestia charakteru prawnego uchwał Rady Edukacji Finansowej zawierających kierowany do Rzecznika Finansowego wniosek o wykorzystanie środków Funduszu Edukacji Finansowej w określony sposób. Uchwała wywiera doniosłe skutki prawne, bowiem wiąże Rzecznika w zakresie wydatkowania wskazanych środków. Ze względu na brak szczegółowej regulacji poświęconej uchwałodawczym kompetencjom Rady, wątpliwości budzi dopuszczalność ich sądowej kontroli. Tymczasem nie da się wykluczyć podjęcia uchwały naruszającej prawo. W artykule zmierzono się z problematyką sądowej kontroli tego rodzaju uchwał.

The article deals with the amendment of the Code of Administrative Procedure and the Law on Proceedings before the Administrative Courts of 7 April 2017, which came into force on 1 June 2017. The authors presented the stages of the legislative process, emphasizing the role of the Administrative Reform Team, which worked from 2012 until 2016 under the auspices of the President of the Supreme Administrative Court. The main ideas of the amendment were characterized in the paper, using the historical and formal-dogmatic method, including the acceleration and simplification of the proceedings, the fuller implementation of the good administration principle, and the inclusion of mediation. According to the authors, applying the new regulation will also speed up administrative court proceedings. In the authors’ opinion, the ideas of the new regulation should be rated positively, although it has shortcomings. That is why it requires some adjustments, especially regarding opposition to the cassation decision.

Artykuł traktuje o nowelizacji Kodeksu postępowania administracyjnego oraz postępowania sądowoadministracyjnego z 7 kwietnia 2017 r., która weszła w życie w dniu 1 czerwca 2017 r. Autorzy przedstawili poszczególne etapy procesu legislacyjnego, akcentując rolę Zespołu do spraw reformy postępowania administracyjnego, który pracował w latach 2012–2016 pod auspicjami Prezesa Naczelnego Sądu Administracyjnego. W opracowaniu, posługując się metodą historyczną oraz formalno-dogmatyczną, scharakteryzowano główne idee nowelizacji, zaliczając do nich przyspieszenie i uproszczenie postępowania, pełniejszą realizację zasady dobrej administracji oraz włączenie do Kodeksu postępowania administracyjnego instytucji mediacji. Zdaniem autorów stosowanie nowej regulacji przyczyni się również do przyspieszenia postępowania sądowoadministracyjnego. Zawarta w opracowaniu ocena ustawy nowelizującej jest pozytywna, choć dostrzeżono także mankamenty omawianego unormowania wymagające pewnych korekt, jak choćby unormowanie poświęcone konstrukcji sprzeciwu od decyzji kasacyjnej.

On 1 June 2017, a major amendment to the Code of Administrative Procedure came into force. The article deals with mediation incorporated into the Code as a new institution of administrative proceedings. The authors presented the advantages and disadvantages of mediation in public matters and discussed the theoretical foundations of this construction. They analysed the effectiveness of the mediation conducted in the proceedings before the administrative courts, pointing that entrusting mediation to professional mediators (by amending the Act of 7 April 2017) was justified. The new regulation provides for mediation that is voluntary, secret, and conducted by an impartial mediator. The amending act does not specify the preferred mediation strategies, leaving this issue to the mediators, but the analysis of the content of the new provisions leads to the conclusion that the evaluative type of mediation is the leading one. The amended provision of Article 13 § 1 of the Code allows mediation in any matter, provided its the nature is sufficiently suitable. In the Authors’ opinion, mediation should be allowed especially in matters that need to be resolved basing on the administrative discretion and in matters whose settlement requires the interpretation of terms that are not specified. In the authors opinion, mediation may be an effective instrument for eliminating administrative disputes but requires proper preparation of the clerks involved.
