There are few countries where the relation between the shaping of democratic society and the development of the media is as perceptible as in Ireland. From the point of view of this paper, the breakthrough came when the media were granted statutory guarantes of freedom of expression and freedom of the media provided by the currently binding Constitution of 1937. Irish media law is going through a period of significant changes that have long been postponed. Some of these changes have only just taken place and it is too early to assess their impact, as is the case with the Defamation Act passed in 2009. There are still others issues waiting to be solved. There are simultaneous and significant processes, such as the digitalization of European television and considerable transformations in Irish society, which stimulate the discussion of changes. A comprhensive assessment of the system should probably be postponed till the end of the reforms, which are stifar from completion.

Until the Nuremberg Trials a gradual change in legal perception of armed conflicts, reflected by the development of norms of conduct, was not matched by an equal growth of instruments of coercive enforcement. Although since then a variety of tools, both preventive and applied during an armed conflict, has been introduced, even (close to) universal recognition of fundamental humanitarian principles does not necessarily translate to the efficiency of legal protection. The greatest obstacle to the enhancement of IHL’s functionality is the control of implementation process at each stage: from gaining confidence of victims often too scared to denounce violations, through cooperation and information circulation among various sometimes “competing” implementing bodies, up to political willingness to act accordingly to supervisors’ and controllers’ postulates. Especially the last element limited effectiveness of initiatives periodically undertaken to shelter children from the horrors of armed conflicts. Establishment in 2005 by the Security Council of the Monitoring and Reporting Mechanism and the working group raises hopes this new political willingness translates into concrete actions. Paper describes background of the SC’s Resolution (including Graca Machel’s earlier report), institutional solutions adopted for greater access to and better circulation of information. Some challenges are also discussed.

Autor artykułu analizuje pewne problemy dotyczące współpracy Wspólnoty Europejskiej z instytucjami międzynarodowymi. Autor koncentruje się na współpracy z ustalonymi strukturami instytucjonalnymi. Jako, że rzadko posiadają one międzynarodową osobowość prawną, współpraca tylko wyjątkowo obejmuje członkostwo w organizacji międzynarodowej. Najpierw autor analizuje trudności, wobec jakich staje Wspólnota Europejska w procesie dostosowania procedur akcesyjnych do zewnętrznych struktur instytucjonalnych. Wdrugiej części opracowania autor podkreśla konsekwencje braku członkostwa Wspólnoty Europejskiej w takich strukturach, dotyczące zarówno tych struktur jak i państw członkowskich UE. Omówiono także pewne skutki omawianych reform konstytucyjnych.
