Przedmiotem opracowania jest analiza, a także sformułowane na jej podstawie wnioski, w kwestii skutków prawnych zaskarżenia decyzji w części, dokonana w aspekcie – stanowiących determinanty standardów demokratycznego państwa prawnego – zasad konstytucyjnych ochrony praw nabytych, dwuinstancyjności postępowania oraz praworządności. Wskazana analiza przeprowadzona została w oparciu o metodę dogmatyczno-prawną oraz prawno-porównawczą, z uwzględnieniem problematyki przymiotu oraz skutków ostateczności decyzji.

This study investigates legal effects of appealing against a decision in part in the context of the constitutional principles of the protection of acquired rights, a two-stage procedure and the rule of law, which are determinants of standards of a democratic state ruled by law, and to formulate relevant conclusions. This is done by means of an analysis of the law in force and a comparative analysis, with a focus on the subject matter of the attribute and effects of a decision’s final force.

Differences in the assessment of individual authorities’ competences are the cause of disputes between them. According to the categories of disputing authorities in the Polish procedure, these disputes are qualified as disputes over jurisdiction and disputes over competences. The category of authorities in dispute and the type of dispute also determine the procedure and the entity authorised to settle the dispute. The prevailing view in judicial decisions is that disputes over jurisdiction and disputes over competence can arise solely against cases pending in administrative proceedings. A review of statutory regulations and judicial decisions proves that disputes over competence of authorities are and may be initiated in cases that are subject to general administrative procedure. In view of the above, this study analyses the law in force and specific cases of such disputes. This analysis is carried out on the basis of examples of regulations and rulings, and attempts to assess them in the light of the legal measure discussed here.

On 1 June 2017, following an amendment to the Code of Administrative Procedure, the possibility to file a statement on waiving the right to appeal was introduced. In consequence – as of the date of serving the public administration authority with the statement of waiver by the last of the parties to the proceedings – the decision becomes final and legally binding. However, it is assumed by legal scholars and commentators and in the established line of judicial decisions that the right to file an appeal against a decision issued in the course of administrative proceedings extends not only to the parties that participated in the proceedings and were served the decision, but also to an entity which was not considered a party by the first instance authority, provided that the entity meets the statutory criterion of obtaining the status of a party to proceedings. The time limit for filing an appeal by the non-participating entity runs from the date of serving or communicating orally the decision to the parties to the proceedings, and in case the decision was served on different dates to more than one party – from the last date of serving the decision. With regard to the legal effect of the waiver of appeal, whereby the first instance decision becomes final and binding, a question arises as to how the waiver affects the possibility to file an appeal, within the original time limit, by an entity which was not considered a party to proceedings by the authority. The paper seeks to answer this question.

Problematyka dotycząca sposobów kwalifikowania oraz statusu prawnego dróg publicznych była już przedmiotem opracowań, w tym także stanowiących omówienie stanowisk judykatury. Niniejsze opracowania w niewielkim zakresie odnoszą się jednak do zagadnienia granic przestrzennych pasa drogowego drogi publicznej. W powyższym zakresie interesująca wydaje się przede wszystkim kwestia, czy istnieją obiektywne kryteria o podłożu normatywnym lub technicznym czy technologicznym, które służą wyznaczeniu granic przestrzennych pasa drogowego. Zagadnienie to, poza względami poznawczymi, wykazuje także istotne znaczenie dla praktyki stosowania prawa, np. w zakresie wykorzystywania przestrzeni nad pasem drogowym na potrzeby inwestycyjne bądź reklamowe. Problematyka ta dotyczy bowiem także budynków i innych obiektów zlokalizowanych ponad pasem drogowym. Ma ona szczególne znaczenie również w związku z okolicznością wejścia w życie ustawy o zmianie niektórych ustaw w związku ze wzmocnieniem narzędzi ochrony krajobrazu. Niniejszy artykuł stanowi próbę określenia zasad i podstaw ustalania granic przestrzennych pasa drogowego drogi publicznej.

The issue concerning the ways of the eligibility and the legal status of public roads has already been the subject of studies, including forming an overview of the positions of the jurisprudence. This development to a minor extent relate to the issues of spatial boundaries of public road’s line. In this respect interesting seems to be primarily a matter of whether there are objective criteria with a standard or technical nature or technology, that the appointment of the spatial limits of the road lane. This issue, in addition to cognitive aspects is also important for the practice of application of the law i.a. inusing the space above the road line for the purposes of advertising banners. This issue also covers buildings and other objects located above the road line. It is also important in view of the fact, that a new Act amending certain laws in connection with the strengthening of landscape protection tools came into force. This article is an attempt to define the principles of and the basis for determining the spatial borders of public road’s line.

As far as the norms of the Code of Administrative Procedure (CAP) are concerned, there is no other category of entities other than a party to the proceedings who could request the authority’s action or whom the authority’s action might concern, as was the case in the regulation of the President of the Republic of Poland of 1928, preceding the CAP, regulating the institution of the person concerned. In the CAP regulation, in the scope of the category of parties to the proceedings, the legislator distinguished parties with disputed interests. The disputed interest is most often manifested in the fact that one of the parties requests the initiation of proceedings in order to obtain a specific entitlement, and the authority deciding in this regard must do so in such a way as not to infringe on the legal interest of other persons (third parties) who, due to the interest in question, in order to ensure its proper protection, use and enjoy the status of a party in the proceedings. For delimiting the above categories of the parties to proceedings, the doctrine and the case-law assume their division into parties with the so-called main rights and parties with the so-called reflexive rights. In the context of the underlined distinction of both sub-categories of parties to proceedings, the object of the analysis of this study is the question of whether or not, according to the provisions of the CAP, the differentiation of their procedural rights can be made. To this end, it was justified to refer to the institution of repealing or amending a final decision pursuant to Article 155 of the PAC, in view of the positions that are presented in the caselaw of the administrative courts in the context of this provision.
