The two-part study concerns the so-called “September crimes” (i.e. the actions of Poles on grounds of nationality against Germans after the outbreak of World War II) in the jurisprudence of the Special Court in Katowice (Sondergericht Kattowitz).The second part of the study concerns “September crimes” directed against health and freedom. The criminal proceedings in these matters were discussed in detail. Particular attention was paid to the arrangements described in the indictment and the findings of the evidentiary proceedings before the court. The circumstances taken into account by the court in assessing particular evidence and legal qualification were presented. In the summary, the results of the Sondergericht Kattowitz case studies in cases related to September accidents were compared to the case law of the Special Court in Bydgoszcz. This comparison showed that both the size of the sentence, as well as the manner and quality of the proceedings by the Sondergericht Kattowitz significantly differed from the Bydgoszcz court. As a consequence, none of the analyzed cases was classified as a judicial crime.

Dwuczęściowe opracowanie dotyczy „przestępstw wrześniowych”, tj. wystąpień Polaków na tle narodowościowym przeciwko Niemcom po wybuchu II wojny światowej, w orzecznictwie Sądu Specjalnego w Katowicach (Sondergericht Kattowitz). W drugiej części opisano przestępstwa przeciwko zdrowiu oraz wolności. W sposób szczegółowy omówiono postępowania karne w tych sprawach. Szczególną uwagę zwrócono na ustalenia opisane w aktach oskarżenia oraz ustalenia postępowania dowodowego prowadzonego przed sądem. Przedstawiono okoliczności brane pod uwagę przez sąd przy ocenie poszczególnych dowodów oraz kwalifikację prawną czynów. W podsumowaniu odniesiono uzyskane wyniki badań orzecznictwa Sondergericht Kattowitz w sprawach o wypadki wrześniowe do orzecznictwa Sądu Specjalnego w Bydgoszczy. Porównanie to wykazało, że zarówno wymiar kary, jak i sposób oraz jakość procedowania przez katowicki sąd specjalny znacząco różniły się od sądu bydgoskiego. W konsekwencji żadnej z analizowanych spraw nie zakwalifikowano jako zbrodni sądowej.

Mortgage registers are very important in the real estate transactions in Poland and in Germany. Every interested person is allowed to view this register. Publicness of mortgage register would not have any meaning if there would not be the pledge of the guarantee of public credibility. This institution protects reliance in entries of mortgage register and facilitates the transactions of real estate. During regulations of public faith warranty, legislator had to settle an essential issue. The question presented is what would happen, if the legal status is different than the status given in mortgage register. Should rather the content of the register be more important? Pledge of The guarantee of public credibility has favorable infl uence on real estate transactions, but may also cause situation in which authorized person would lost property without any guilt.

The article analyses a criminal case before a German Special Court in Katowice in 1943. The valid and binding decision was successfully appealed by a prosecutor resorting to a an extraordinary legal remedy, complaint caused by the invalidity of such a sentence. In the first trial, Roman Gawronski was convicted of illicit trading and theft, and sentenced to a total of 12 years hard labour. After a complaint lodged by the prosecutor, the Special Court in Katowice issued the correct sentence, being the death penalty. The article examines the legal foundations of both rulings and arguments of the prosecutor supporting the invalidation of a final judgment. It also provides an overview on the structure and procedure in the special courts.

Artykuł analizuje sprawę karną zawisłą przed niemieckim Sądem Specjalnym w Katowicach w 1943 r. Jej cechą charakterystyczną jest fakt, że zapadłe orzeczenie zostało skutecznie zaskarżone przez prokuratora nadzwyczajnym środkiem prawnym – skargą z powodu nieważności. W ramach pierwszej rozprawy Roman Gawronski został skazany za pokątny handel i kradzież na karę łączną 12 lat ciężkiego więzienia. Po wniesieniu skargi przez prokuratora Sąd Specjalny w Katowicach wydał właściwy wyrok: karę śmierci. W artykule przeanalizowano rozważania prawne obu wyroków oraz argumentację prokuratora przemawiającą za uchyleniem prawomocnego wyroku. W zarysie przedstawiono także ustrój oraz postępowanie przed sądami specjalnymi.

The article discusses Polish colony in Manguria from 1897 to 1949. The first part of the work, devoted to the history, describes the circumstances of the formation of colony, its development and fall. The colony history was presented in the light of great historical events that influenced it. The second part includes a detailed analysis of selected issues. It concerns Polish political organizations, consulate, Gospoda Polska, schooling and church organizations. Also, the period of repatriation of the last colonists was thoroughly discussed. Special emphasis was put on legal issues, such as jurisdiction in the colony territory. Also, the Colony’s relations with the country, and relationships between colonists and country authorities Manguria was ruled under. Poles’ struggle for maintaining political autonomy and cultural identity was show. At the same time, internal conflicts within the colony were presented. The article closes with a short reflection within the philosophy of law.
