The article presents a linguistic analysis of a charter from the 17th century entitled “Wilkierz dla wsi klasztoru Panny Marji w Kartuzach” published by Stanisław Kutrzeba and Alfons Mańkowski in 1938 in “Archiwum Komisji Prawniczej, volume 11”. The text of an unknown scrivener was written in New High German in the Silesian dialect, which can be proved on the basis of the legal notation. The author shows the results of his analysis demonstrating the stage of the development of the vowels in the unstressed syllables with the appropriate examples.

The article presents the results of the phonemic-graphemic analysis of the German dispositions upon death drawn up by spouses from the first half of the 14th century, which come from the town council of Zgorzelec (Görlitz). The dispositions constitute a part of the first liber civitatis of Zgorzelec (Görlitz). The aim of the paper is to answer the question how far the script fixes the features of the spoken language. Due to the analysis it could be unambiguously proved, the German used in the text corresponds to the level of development of the German language within the periodization of history of the language as it contains the standard Early New High German features as well as the dialectal structures and the sound changes, which are characteristic for the Silesian dialect. The text can therefore be classified as one of the linguistic monuments of the East Central German of Silesian tradition. All the results of the exploration are supported with the appropriate examples.

The paper presents the results of the language analysis of the (Early) New High German village charters from the 17th and 18th centuries which come from: Archiwum Komisji Prawniczej, Volume XI, (Warszawa/Kraków/Łódź/Poznań/Wilno/Zakopane, 1938) and Targowski (2013). The scriveners are unknown. The center of attention are the ways of marking of the long and short vowels, which came into being owing to the lengthening and shortening of the vowels in the Early New High German time. The aim of the article is to determine to what extent the script fixes the features of the spoken language. The author introduces the results of his analysis, illustrating the characteristic features with appropriate examples.

Językowy obraz świata, stanowiący warunkowany przez daną kulturę i odzwierciedlony w języku sposób percepcji świata, oraz komunikacyjna funkcja języka, stanowić mogą bazę dla dociekań, czy – i ewentualnie w jakim stopniu – dane pojęcie używane w akcie komunikacji odzwierciedla zamysł mówiącego oraz odpowiada odbiciu obrazu tegoż pojęcia w jego świadomości oraz czy owo wyrażane przez komunikującego słowo ewokuje taki sam – albo przynajmniej podobny – obraz w świadomości odbiorcy przekazywanego komunikatu. Ranga tego zagadnienia uwypukla się w szczególności w odniesieniu do języka prawnego, w ramach którego precyzja wypowiedzi powinna być podstawowym dążeniem ustawodawcy. Niniejszy artykuł stanowi próbę odpowiedzi na pytanie, czy pojęcia polskiego i niemieckiego języka prawa spadkowego zawsze oddają treść, którą mają opisywać, czy też istnieją w tych językach takie słowa, które na płaszczyźnie językowej sugerują inną treść prawną, niż ta, której nośnikiem mają one być w założeniu ustawodawców. W artykule zaprezentowane zostały wyniki analizy wybranych pojęć opisujących instytucje prawa spadkowego pod kątem pełnionej przez nie funkcji referencyjnej w nawiązaniu do odzwierciedlonego w nich językowego obrazu świata.

The linguistic image of the world, constituting the way of perceiving the world conditioned by a given culture and reflected in its language, and the communicative function of language, may constitute the basis for inquiries as to whether – and possibly to what extent – a given concept used in the act of communication reflects the speaker’s intention and corresponds to the reflection of an image of the concept in his/her consciousness and whether the word expressed by the communicator evokes the same – or at least a similar – image in the consciousness of the recipient of the transmitted message. The importance of this issue is emphasized in particular with regard to a legal language, where the precision of expression should be the legislator’s primary aspiration. This article is an attempt to answer the question as to whether the terms of the Polish and German language of inheritance law always reflect the content they are meant to describe, or whether there are words in these languages that on the linguistic level point to a different legal content than the one they are supposed to convey according to lawmakers. The article presents the results of the analysis of selected concepts describing the institutions of inheritance law in terms of their reference function to the linguistic worldview reflected in them.

This article presents an attempt to show the specific features of the German legal language in the chosen wills of the nobility from Royal Prussia of the 17th century, in the area of German settlement in the East. The investigation aims to answer the question as to whether the examined testaments suit the pattern of the will as a text type. The author focuses on the graphemic, lexical and syntactic levels of the testament. The outline of structure and function of wills provides the background for such a defined research area.
