As of 7 November 2019, the provisions on horizontal complaints (complaints against a decision or order of a court of first instance to another panel of that court) apply in civil proceedings. These complaints may be heard by district courts. The provisions determining the minimum rates of remuneration and fees for the activities of advocates and legal advisers do not provide for the amount of such rates or fees for legal representation in complaint proceedings before the district court. This gap cannot be filled by a regulation allowing the application of the rate or fee foreseen for the case of the most similar nature. While it is permissible to apply by way of legislative analogy the provisions setting out the rates and fees for legal representation in complaint proceedings before the district court, a legislative amendment is desirable.
