The paper aims to answer the question whether the drafts of directives No 892 and 893 contain adequate legal solutions enabling effective implementation of a temporary ban on cloning and placing clones and food from animal clones on the EU market. This issue has been analysed in light of Regulation No 258/1997 on placing on the market food and elements of food (ingredients) which to date have not been to any significant extent used for human consumption. The authors concludes that the draft directives propose special solutions, absent in Regulation 258/97 as regards food from animal clones. Once the prohibition anticipated in the draft directives comes into force, it will be highly unlikely that such food, in its own form or as new food, will be capable of being placed on the EU market. However, it may be rather difficult to identify food from cloned animals, and a prohibition of cloning animals or introducting clones in trading in the scope defined in the EU draft directives will not eliminate the problem of cloned food identification in the case of imported food.

L’obiettivo dell’articolo è quello di tentare di rispondere alla domanda se le proposte delle Direttive n. 892 e 893 contengono soluzioni giuridiche sufficienti per realizzare il divieto temporaneo di immettere sul mercato dell’Ue gli alimenti provenienti da animali clonati e da clonazione. Questo problema è stato esaminato alla luce del regolamento n. 258/1997 che riguarda in particolare l’immissione in commercio degli alimenti e degli ingredienti alimentari i quali fino ad allora non sono stati ampiamente utilizzati per il consumo umano, e i quali sono tra quelli elencati in questo atto giuridico. In conclusione l’autrice afferma tra l’altro che le Direttive n. 892 e 893 in fase di proposta introducono soluzioni speciali rispetto al Regolamento n. 258/97 in materia di ammissione dell’introduzione in commercio degli alimenti provenienti da animali clonati. Dopo l’entrata in vigore dei divieti previsti nelle Direttive, come sembra, non sarà possibile l’immissione in commercio all’interno dell’Ue degli alimenti provenienti da cloni oppure da nuovi alimenti. Possono sorgere qui le difficoltà riguardanti le questioni di tracciabilità dei prodotti provenienti da cloni. In particolare l’istituzione del divieto di clonazione degli animali e dell’immissione in commercio di animali clonati nell’ambito delle proposte di direttive non escluderà il problema della traccibilità dei prodotti dei cloni nel caso delle loro importazioni.

The purpose of this paper is to formulate a preliminary assessment of the selected solutions of the Common Agricultural Policy as to whether they are adequate from the perspective of the objectives of the SFS. Sustainability of food systems has become a complex process, dependent on a number of environmental, economic, and social factors. The authors assess that the instruments for supporting Sustainable Food Systems included in the national strategic plan are adequate to the goals of these systems, but some reservations can be raised about them. In particular, in addition to measures that are certainly beneficial and consolidating (e.g., supporting the reduction of antibiotic use in livestock production and pesticide use in crop production), the national strategic plan lacks larger-scale instruments (important from the point of view of the big picture) to support, for example, the introduction of resource-efficient and climate-resilient production, the promotion of a healthy and sustainable diet, the wider introduction of quality food (not only organic), the reduction and combating of food waste, the proper storage of food, or the reduction and management of waste generated in the food chain. The relative nature of the conditionality mechanism remains a shortcoming.
