In the article the Author explains l) the preliminary investigation according to the Code of Canon Law of 1983, 2) the preliminary investigation in the selected documents issued after the Code of Canon Law of 1983 and 3) offenses under pain of dismissal from the clerical state. The legislator included in can. 1717-1719 of the Code of Canon Law of 1983 provisions obliged the ordinary to conduct the preliminary investigation. This investigation precedes a possible penal process. The preliminary investigation can be defined as a preparatory measure aimed at detecting a crime, circumstances of an offense and inquiring the imputability of perpetrator. This stage of proceeding is marked by a caution and prudence lest anyone's good name be endangered by this investigation. Due to the nature of the punishment – dismissal from the clerical state – the investigator inquiring the facts and circumstances of an offense has to be prudent.
The subject of this article refers to the significant issue in the contemporary world connected with family. The Author shows that to answer this question different aspects need to be analyzed: sociological, psychological, legal, theological and philosophical. Neither documents of the state law nor canon law include the statement “a right to have a child”. “A right to have a child” is very often a rejection of the natural law. The Author points to the fact that we can not accept the expression “a right to have a child”. In the article the possibility of being parents is accented.

Tematyka artykułu odnosi się do istotnego we współczesnym świecie zagadnienia związanego z rodziną. Autor pokazuje, że aby odpowiedzieć na to pytanie, należy przeanalizować różne aspekty: socjologiczny, psychologiczny, prawny, teologiczny i filozoficzny. Ani dokumenty prawa państwowego, ani kanonicznego nie zawierają sformułowania „prawo do posiadania dziecka”. „Prawo do posiadania dziecka” jest bardzo często odrzuceniem prawa naturalnego. Autor zwraca uwagę, że nie można zaakceptować sformułowania „prawo do posiadania dziecka”. W artykule zaakcentowana jest możliwość bycia rodzicami.

The issue of celibacy obligations for clerics according to the Code of Canon Law of 1983 was taken up in the article. This problem contains the following items: 1) theological and legal basis for the celibacy obligation; 2) celibacy obligation in the Code of Canon Law of 1983; 3) celibacy in selected documents issued after the Code of Canon Law of 1983; 4) conclusion. Legislator in can. 277, binding the clerics to celibacy, indicates the source of this obligation, what is the candidate’s own will to the orders. According to the can. 277, celibacy means chastity sensu stricto (in a perfect way). Canon Law regulation concerning celibacy law has a long Church tradition. When cleric does not obey this obligation, penal sanctions are applied. Celibacy which is voluntarily accepted and experienced in a proper way is a spiritual reality sign, contributes to the salvation of souls which is the supreme law in the Church.
