W dniach 12-14 listopada 2014 r. w siedzibie Międzynarodowego Centrum Kultury w Krakowie odbyła się międzynarodowa konferencja pt. „Zrabowane odzyskane dobra kultury – przypadek Polski”, zorganizowana przez Ministerstwo Kultury i Dziedzictwa Narodowego oraz Międzynarodowe Centrum Kultury w Krakowie. Celem konferencji była nie tylko wymiana doświadczeń w zakresie restytucji dóbr kultury, nawiązanie wspólnego dialogu oraz wypracowanie propozycji usprawnienia praktycznych aspektów tego jakże ważnego dla zachowania integralności kulturowej procesu, lecz również popularyzacja wiedzy o utraconym dziedzictwie kultury i podniesienie świadomości na temat skali polskich strat wojennych.

Problematyka artykułu dotyczy egzekwowania nadzoru konserwatorskiego w toku administracyjnego postępowania egzekucyjnego od dysponenta zabytków, wobec którego toczy się postępowanie upadłościowe. Zagadnienie to nie było dotychczas przedmiotem pogłębionej analizy na gruncie literaturowym, mimo że sprawia ono liczne problemy wojewódzkim konserwatorom zabytków na etapie egzekwowania decyzji konserwatorskich. Poczynione rozważania poprzedzone zostały charakterystyką administracyjnego postępowania egzekucyjnego z obowiązku ochrony zabytków i opieki nad zabytkami, a także zbiegu egzekucji. Całość rozważań podsumowują wnioski de lege lata oraz de lege ferenda, a przeprowadzona analiza prawna ukazuje wymiar i znaczenie omawianego problemu dla praktyki egzekwowania nadzoru konserwatorskiego.

This article is devoted to the enforcement of conservation supervision in the course of administrative enforcement proceedings from a monument’s holder with regard to whom a bankruptcy proceeding is pending. To date, the subject matter has not been thoroughly analyzed by a discussion of the literature, despite the fact that it causes numerous problems to voivodeship conservators of monuments at the stage of enforceming conservators’ decisions. Observations on the subject will be preceded by a description of administrative proceedings to enforce performance of the duty to protect and care of monuments, as well as of the possible concurrence of proceedings. The study ends with conclusions de lege lata and de lege ferenda, and the legal analysis presented will show the scope and significance of the issue for the practice of enforcing the performance of conservation supervision.

The issues discussed in this article concentrate on selected legal and economic aspects of the art rental institution. Civil Code regulations do not contain a specific art rental contract. It is shown in practice that temporary loans of historic objects (or, in a broader sense, culture goods) take place on the basis of a loan contract, leasing contract or a commodate. What is worth our attention is the fact that the art rental institution should be approached on two layers. The first one includes temporary loans of historic objects for display purposes in Poland, the other represents the promotion of the Polish culture abroad and participation of Polish historic objects in foreign exhibitions. From an economic point of view, the art rental services market is not identical with the art market. Consumers of these two markets differ greatly from one another, thus, they cannot be classified in conjunction. The market analysis carried out in this study indicated an increase in the number of companies specialised in temporary loans of historic objects, which allows us to speculate that there is certain demand for a given service. Is it true that a trend consisting in temporary loans of works of art for decorative purposes has found its way to Poland?
