Abstrakty

W artykule przeanalizowano gwarancje, jakie - w świetle Konstytucji Rzeczypospolitej Polskiej - wynikają ze zlecania zadań rządowych jednostkom samorządu terytorialnego. Przekazywanie zadań zleconych ma swoją odrębną podstawę w art. 166 ust. 2 Konstytucji RP. Jednakże całokształt uprawnień samorządu należy oceniać również w świetle przepisów regulujących ustrój samorządu terytorialnego w Polsce, jego samodzielność, w tym także samodzielność finansową. Poszczególne gwarancje można wywodzić z zasady samodzielności i charakteru zadań, obowiązku przekazywania tych zadań ustawą, nakazu wskazania uzasadnionej potrzeby zlecenia zadania, a także zasady wyposażenia jednostek samorządu terytorialnego w środki adekwatne do przekazanych zadań. Choć zakres tych gwarancji różni się istotnie od gwarancji związanych z wykonywaniem zadań własnych, to jednak nie dopuszcza do całkowitego wyłączenia samodzielności samorządów co do wykonywania zadań zleconych.(abstrakt oryginalny)

The article analyses the guarantees which, in the light of the Constitution of the Republic of Poland, arise from the commissioning of government tasks to local authority units. The transfer of commissioned tasks has a separate basis under Article 166, para. 2 of the Constitution of the Republic of Poland. However, all of the local authority's rights should also be assessed in the light of the provisions governing the system of local government in Poland and its independence, including its financial independence. The individual guarantees can be argued from the principle of independence and the nature of the tasks, the obligation to transfer these tasks by statute, the requirement to specify the justified needs to commission the task and the principles of establishing local authority units with resources that are adequate to the tasks transferred. Although the scope of these guarantees differs significantly from the guarantees related to the performance of own tasks, it does not allow for the exclusion of complete independence of the local authorities regarding the performance of commissioned tasks.(original abstract)
