Abstrakty

Przedmiotem artykułu jest przedstawienie podstaw prawnych, składu osobowego i zadań administracji konsultacyjnej w polskim i we francuskim samorządzie terytorialnym. Analiza normatywna struktur komisji wewnętrznych, komitetów i innych ciał konsultacyjnych we wspólnocie terytorialnej umożliwia przedstawienie propozycji zmiany dotychczasowych rozwiązań prawnych w zakresie administracji konsultacyjnej w polskim samorządzie terytorialnym, wzorem francuskich rozwiązań, wzbogaconych o dotychczasowe doświadczenia partycypacji społecznej. Powołanie komisji i komitetów w polskim porządku prawnym jako ciał konsultacyjno-inicjatywnych, z otwarciem na aktywny udział mieszkańców w tych ciałach, uznać należy za pożądany kierunek zmian w aktualnym samorządzie terytorialnym.(abstrakt oryginalny)

The subject of the article is a presentation of the legal bases, personal composition and tasks of the consultative administration in the Polish and French local government. A normative analysis of the structures of internal committees, commissions and other consultative bodies in the territorial community makes it possible to present a proposal to change the existing legal solutions in the area of consultative administration in the Polish local government, modelled on French solutions and enriched by previous experiences of social participation. The establishment of committees and commissions in the Polish legal order as consultative and initiative bodies, with an openness to the active participation of residents in these bodies, should be considered as a desirable direction of changes in the current local government.(original abstract)
