Abstrakty

2 lipca 2008 r. Komisja Europejska korzystając z inicjatywy ustawodawczej zgodnie z art. 293 TFUE przedłożyła Parlamentowi Europejskiemu i Radzie projekt dyrektywy w sprawie wykonywania praw pacjenta w transgranicznym zaopatrzeniu zdrowotnym1. Projekt ten po dość długim okresie oczekiwania został przyjęty przez Radę Europejską podczas jej szczytu w dniach 16-17 grudnia 2010 r. Osiągnięto tam kompromis dotyczący ostatecznego kształtu dyrektywy. Następnie Parlament Europejski przyjął tę wersję w drugim czytaniu dnia 1 stycznia 2011 r. Dyrektywa więc najprawdopodobniej zostanie przyjęta na następnym posiedzeniu Rady. Celem tego projektu, mającego swój zaczątek w orzeczeniach Europejskiego Trybunału Sprawiedliwości (TS), jest stworzenie przejrzystych ram do transgranicznego świadczenia usług medycznych wewnątrz Unii Europejskiej, oraz stworzenie opieki medycznej o wysokim standardzie, która jednocześnie byłaby wydajna i bezpieczna. First part of the article contains of a short review on the development of jurisdiction of the European Court of Justice in the area of cross-border medical treatment. Furthermore, it focuses on the solutions applied by the draft directive on the execution of patients' rights in cross-border health care system as it was implemented by the European Parliament at the end of January, 2011. Herein, problems and rules concerning refund of medical expenses within the territory of the European Union are described. Moreover, the article analyses the duties of Member States where the treatment is carried out, types and limits of using health care, in particular problems evoked by refund of medical expenses and a possibility of introducing by a Member State a system of pre-consent. At the end of the article there is a short evaluation of the draft directive included and the possible time line for the new regulation to be put into effect. (original abstract)
