Investment Policy of Polish Pension Funds versus the Principle of Free Capital Flow in the EU

Abstrakty
Omówiono prawne aspekty lokacji polskich funduszy emerytalnych w kontekście przepisów Komisji Europejskiej. Zwrócono uwagę na istotę polskiego systemu emerytalnego po reformie oraz na sytuację otwartych funduszy emerytalnych (OFE).
In 2008 the problem of changes in socal insurance regulations, connected with finalising the pension system reform, was widely discussed. There is a need for a deepened analysis and corrections of regulations of the acts about organisation and functioning of pension funds (OFE) and of executive regulations. Investment capabilities of pension funds have not changed over the last ten years. The article also deals with objections of the European Commission, presented to the Polish government, concerning incompatibility of article 56 of the EU Treaty with the act about pension funds. The Commission points out that there is collision between Polish regulations and the principle of free flow of capital. The author makes an attempt at analysing those standpoints and presents his own opinion about the investment policy of Polish pension funds. (original abstract)
