Abstrakty

Jeden z głównych celów kontraktów budowlanych jest wyraźne przypisanie ryzyka i odpowiedzialności, w zrozumiały i jednoznaczny sposób. Inaczej spory (również prawne) pomiędzy stronami kontraktu będą nieuniknione, co zawsze prowadzi do dodatkowych kosztów obu stron. Celem artykułu jest analiza podziału ryzyka między uczestników procesu budowlanego (przedsiębiorcę i klienta) w czasie realizacji projektów budowlanych. (AT)

One of the main purposes of construction contracts is to allocate risk and liability clearly, comprehensibly and unambiguously. Otherwise, disputes (also legal) between contract parties are inevitable, which always leads to extra expenses incurred by both parties. The aim of the paper is to analyse the allocation of risk between the participants of a construction process (the contractor and the client) when implementing construction projects.
