Autor wskazuje na ograniczenie liczby i czasu trwania kontroli PIP w odniesieniu do pracodawców prowadzących działalność usługową, wynikające z zakresu konwencji nr 81 Międzynarodowej Organizacji Pracy. Zwraca także uwagę na możliwość ograniczenia przedmiotu tej kontroli w zakładach przemysłowych i handlowych. Wskazuje również na to, iż pojęcie przepisów prawa podlegających kontroli jest węższe w konwencji niż w prawie polskim. (abstrakt oryginalny)

According to the Polish law the control of enterprises is limited unless an international treaty provides otherwise. Art. 16 of Labour Inspection Convention, 1947 (No. 81) declares that "Workplaces shall be inspected as often and as thoroughly as is necessary to ensure the effective application of the relevant legal provisions". It is related to the labour inspection in industrial and commercial workplaces. The extension of the provisions of the Convention No. 81 to activities in the non-commercial services sector requires the ratification of the Protocol of 1995 to this Convention. Poland has not done it. Thus, there is no legal basis to the unlimited controls of Labour Inspection in this sector. Similarly the 2007 Polish Law on State Labour Inspection provides for the broader scope of Inspection competencies than ILO Convention. Under Convention the term "legal provisions" includes, in addition to laws and regulations, arbitration awards and collective agreements but not the work regulations as in the Polish law.
