W opracowaniu przedstawiono problem delimitacji swobody prowadzenia działalności gospodarczej i świadczenia usług w odniesieniu do sektora bankowego. Główna część artykułu stanowi próbę zastosowania ogólnych poglądów doktryny i orzecznictwa do konkretnego przypadku banków.

The goal of this essay is to show the problem of distinction between two freedoms in a specific scope of commercial activity - banking. Distinction between two freedoms is a very difficult legal problem, analysed by professors of law and judges of European Court of Justice. The main part of this essay is an attempt at applying general opinions on distinction problem in banking. Morever, there is a suggestion for Polish legislator, that implementation of European law into Polish legal system should be done in unquestionable and clear way. There is a proposal on how to understand the distinction problem in Polish Banking Act. (original abstract)
