Analizując zagadnienie odpowiedzialności Prezydenta RP odwołano się do art. 126 Konstytucji Rzeczypospolitej Polskiej z 1997 r. Normy w nim zawarte określają prezydenta jako najwyższego przedstawiciela polskich władz, gwaranta ciągłości władzy państwowej oraz najwyższy organ państwa w zakresie władzy wykonawczej. Z uwagi na fakt, iż głowa państwa nie ponosi odpowiedzialności politycznej prezydent nie jest poddawany pod ocenę parlamentu i innych organów państwowych. Szczególną uwagę zwrócono na odpowiedzialność konstytucyjną i karną. W tekście przedstawiono procedurę usunięcia z urzędu, co nie jest równoznaczne z automatycznym odsunięciem od sprawowania władzy ani odebraniem immunitetu. Zaprezentowano proces postawienia prezydenta przed Trybunałem Stanu. W ramach artykułu omówiono kwestie związane z naruszeniem i przekroczeniem – przez prezydenta – konstytucji i ustaw, w sposób widoczny dla społeczeństwa.

The scrutiny of the functions and responsibilities of the President of the Republic of Poland was based primarily on the article 126 of the Polish Constitution of 1997. The regulations define the President as the supreme representative of the Polish authorities, the guarantor of the continuity of the Government and the supreme authority in respect of the executive. Due to the fact that the head of state has no political responsibility before the Parliament or other authorities, the constitutional responsibility and criminal liability were highlighted. This text shows the impeachment procedure as well as presents the process of bringing the President before the State Tribunal. The article also discusses issues related to the violation and breaching of both the Constitution and the law apparent to the public.
