The Juridification of Legal Interpretation Grounded in the Polish Civil Code Project of 2008

Abstrakty
The deliberations made hereby, deals with Articles 3 and 4 of the draft of the first charter of a new Polish Civil Code (the project of 2008), drown up by the Codification of Private Law Commission, upon the conduct of Professor Zbigniew Radwański. These provisions, in authors’ views, tend to juridificate the directives of legal interpretation, which are grounded in the Polish’s legal theory. The purpose of the article is, on the one hand, to analyse submitted project through the prism of the principles of techniques of a proper legislation, and – on the another – to analyse it by the perspectives of detailed law studies – the legal theory, the constitutional law and the European law. In addition to submitted project, the authors propose to delay that provisions. The criticism is fully supported by authors’ own proposals, which let the faults to be almost completely corrected. Nevertheless the proposed solutions should not became a written part of a Polish legal system. That is, what the authors intended to explain.
