Abstrakty
In the system of Polish law the labor law constitutes a separate branch. Consequently, it includes specific norms concerning parties in the employment contract. The notion of the employer is not identical with the notion of the subject of the employment contract. It is possible for a unit without a legal entity to become an employer. it happens that a physical person employs workers. At the same time a unit like this forms a specific organizational unit necessary for running a business. As a result, it is a natural person and not an organizational unit formed by them that becomes an employer. Despite various controversies we should accept the view that it is an unlimited liability partnership and not its partners that become employers. Being a legal entity is sufficient for employing workers. Organizational units within the structure of a legal entity may become employers if they are distinguished organizationally and their management structures have their own competence to employ workers.
