Abstrakty
The right to a fair trial is guaranteed in Art.6, European Convention on Human Rights and Basic Freedom Protection of November, 4th 1950. It makes the basis for the European Human Rights Tribunal verdicts and is in accordance with Polish constitutional and judicial regulations. In the article the author has discussed the right to a fair trial problems. He has reached to the genesis of the fair trial law making from the 13th to 20th century and he has complemented these issues with the study of basic regulations concerning the right to a fair trial since the Human Rights Declaration on December, 10th 1948 up to the present time. On this background, European and Polish systems of human rights protection exposing the right to a fair trial has been discussed. The whole considerations are exemplified with the European Human Rights Tribunal verdicts (one of them concerned a Polish citizen). In the process of Poland’s integration with European structures and in building a democratic state, one should pay attention to international human rights standards, among which the right to a fair trial is placed on a high position.
