Selected issues on the Spanish geographical information system for CAP

Abstrakty
The aim of the paper is to present to the reader the Spanish experience on the introduction and maintenance of the geographical information system for Common Agricultural Policy and to find out whether and to what extent this experience might be used in Poland. The paper contains an analysis of the Spanish normative framework of the SIGPAC system, established under the royal decree 2128/2004 of 29 October 2004 on the regulation of geographical information system of agricultural parcels. In addition, the article gives an overview on the provisions of the decree by Catalonian Autonomous Community (issued by the Department of Agriculture, Food and Rural Activity) No 245/2008, which regulates in details the way the system is used within its territory. Among the solutions which might be of greater interest for Poland the Author points at the legal mechanism clarifying inconsistencies between the SIGPAC system and property cadastre and also the procedures and methods for system up-date. Further on, the paper underlines the scope of public access to data kept in the system.
L’obiettivo dell’articolo è quello di avvicinare il lettore alle esperienze spagnole relative all’introduzione e al mantenimento del sistema informativo geografico per la Politica Agricola Comune, nonché il tentativo di rispondere alla domanda in che modo queste esperienze possono essere sfruttate in Polonia. L’articolo comprende l’esame del contesto giuridico del sistema spagnolo SIGPAC disciplinato con il decreto reale 2128/2004 del 29 ottobre, relativo alla regolazione del sistema informativo geografico delle parcelle agricole. Esso presenta anche le disposizioni del decreto del dipartimento dell’agricoltura, alimentazione e attività rurale n. 245/2008 della comunità autonoma di Catalonia, che regola in modo dettagliato l’uso del sistema nel suo territorio. Secondo l’autrice le soluzioni più interessanti che meritano di essere prese in considerazione in Polonia consistono nel meccanismo giuridico del chiarimento di contraddizioni tra il sistema SIGPAC ed il catasto degli immobili, nonché il procedimento ed il metodo dell’aggiornamento del sistema. Interessante è anche la possibilità per i cittadini di accedere ai dati contenuti nel sistema
