Abstrakty

The paper expolores the newly developed technologies operating on the basis of artificial intelligence and their use in two areas, namely in maritime transport and in aviation, in the context of valid norms of international public law. The paper defines the basic terms in relation to autonomous cargo ships and aircraft. It contains a reflection of the current treaties as well as reflections on its progressive development. In relation to the issue of autonomous ships, the paper assesses their use under the UN Convention on the Law of the Sea. The paper also reflects on the activities of the International Maritime Organization in relation to autonomous ships and contains ideas regarding the possible future progressive development of international law in this area. In relation to the issue of autonomous aircraft, the paper assesses their use according to several relevant international treaties and according to two regulations of the European Commission. The paper also reflects the activities of the International Civil Aviation Organisation in relation to autonomous aircraft and, similarly to the case of autonomous ships, contains ideas about the further possible development of legal norms in this area.

Příspěvek je věnován nově vyvíjeným technologiím fungujícím na bázi umělé inteligence a jejich využití ve dvou oblastech, a sice v námořní dopravě a v letectví v kontextu platných norem mezinárodního práva veřejného. Příspěvek vymezuje základní pojmy a ve vztahu k autonomním lodím a letadlům obsahuje reflexi současné právní úpravy a také úvahy o jejím dalším vývoji. Ve vztahu k problematice autonomních lodí příspěvek posuzuje jejich použití podle Úmluvy OSN o mořském právu. Příspěvek také reflektuje činnost Mezinárodní námořní organizace ve vztahu k autonomním lodím a obsahuje úvahy o možném budoucím progresivním rozvoji mezinárodního práva v této oblasti. Ve vztahu k problematice autonomních letadel příspěvek posuzuje jejich užití podle několika relevantních mezinárodních smluv a podle dvou nařízení Evropské komise. Příspěvek rovněž reflektuje činnost Mezinárodní komise pro civilní letectví ve vztahu k autonomním letadlům a podobně jako v případě autonomních lodí obsahuje úvahy o dalším možném rozvoji právní úpravy v této oblasti.
