The purpose of this essay is not to present a concept of metaphor in legal discourse, which belongs to the theory and philosophy of law, but only to draw attention to the spread of metaphor in the legal language and the law and the need for more systematic approach to the analytical structure and function of the legal metaphor in the legal system understood as consisting of legal norms, judicial decisions and legal doctrine.

Celem niniejszego szkicu nie jest przedstawienie koncepcji metafory w dyskursie prawniczym, co należy do teorii i filozofii prawa, lecz jedynie zwrócenie uwagi na rozpowszechnienie się metafory w języku prawnym i prawniczym oraz na konieczność bardziej systematycznego opracowania struktury analitycznej metafory prawniczej i funkcji, którą pełni w systemie prawa rozumianym szeroko, czyli składającym się z norm prawnych, orzecznictwa sądowego i doktryny prawniczej.
