Immunities and privileges enjoyed by UN staff members limit the possibility of their responsibility before national courts in the event of a crime. For this reason, the internal justice system of the United Nations was set up and it provides that a UN staff member may be subject to disciplinary action for breach of duty while performing its work. This organization, employing thousands of employees, must ensure that all officers, regardless of their position, are subject to the internal justice system and that their violations may result in UN sanctions. Whether the disciplinary measures will be imposed depends, however, to a large extent on the UN Secretary General. The results of the investigation of the special unit - OlOS are only recommendations. It is rare to initiate proceedings against senior officers. The aim of this article is therefore to present disciplinary procedures within the UN and to indicate what changes disciplinary procedures need. Disciplinary cases are particularly important for evaluating the activities of international organizations, especially for the Organization, which is a guardian of peace and human rights in the world.

Przysługujące funkcjonariuszom ONZ immunitety i przywileje ograniczają możliwość pociągnięcia do odpowiedzialności przed sądami krajowymi w razie popełnienia przestępstwa. Z tego powodu przewidziano wewnętrzny system sprawiedliwości ONZ, w ramach którego funkcjonariusz ONZ może ponieść odpowiedzialność dyscyplinarną za naruszenie obowiązków podczas wykonywania pracy. Organizacja ta, zatrudniając tysiące pracowników, musi zapewnić, że wszyscy funkcjonariusze, bez względu na stanowisko, podlegają wewnętrznemu systemowi sprawiedliwości i ich naruszenia mogą spotkać się z sankcją ze strony ONZ. To, czy środki dyscyplinarne zostaną nałożone zależy jednak w dużym stopniu od Sekretarza Generalnego ONZ. Wyniki śledztwa specjalnego organu OIOS stanowią tylko rekomendacje. Wobec funkcjonariuszy wyższych rangą rzadko wszczyna się postępowanie. Celem artykułu jest zatem zaprezentowanie procedur dotyczących odpowiedzialności dyscyplinarnej w ramach ONZ i wskazanie potrzebnych zmian w zakresie tych procedur. Sprawy dyscyplinarne są szczególnie ważne dla oceny działalności organizacji międzynarodowych, zwłaszcza dla Organizacji, która stoi na straży pokoju międzynarodowego i ochrony praw człowieka.
